Headnote:The petitioner approached the court under Articles 21 and 300-A of the Constitution of India, seeking a Writ of Mandamus to direct the respondents to handover 5.88 square yards of land. This land was the remainder of a total extent of 95.05 square yards after the acquisition of 89.17 square yards. The court noted that the petitioner's grievance was specifically limited to the pending disposal of a representation dated 03.01.2026 submitted to the Special Deputy Collector (L.A.). The central issue was whether the respondents should be directed to consider the petitioner's representation regarding the leftover land. The court observed that the government counsel agreed to consider the representation and take appropriate action in accordance with the law. this writ petition is disposed of with consent directing the respondent Nos.3 & 4 to consider the representation of the petitioner dated 03.01.2026 and pass appropriate orders strictly in accordance with law, within a period of three (03) weeks from the date of receipt of copy of this order.

ORDER

This Writ Petition has been filed seeking the following prayer:

“…to issue any Writ, Order of Direction, more particularly one in the nature of Writ of Mandamus, declare the action of the respondents in not handing over the left over land to an extent of 5.88 square yards, which was remained after acquiring 89.17 square yards out of total extent of land 95.05 square yards of the petitioner situated in Door No.22-8-428 & 435, Purana haveli, Hyderabad as bad, illegal, arbitrary, unjust, improper, contrary to law, contrary to Land Acquisition Proceedings and in violation of Articles 21 and 300-A of the Constitution of India and consequently direct the respondents to handover the land an extent of 5.88 square yards to the petitioner, which was remained after Land Acquisition Proceedings and pass such other order…”

Today when the matter is taken up for hearing, though raised various grounds in the writ petition, however learned counsel for petitioner has limited his grievance to the aspect of disposing representation dated 03.01.2026 submitted to The Special Deputy Collector (L.A.)/respondent No.3, which is pending for consideration.

3. Learned Assistant Government Pleader appearing for Land Acquisition submits that the representation dated 03.01.2026 would be considered and appropriate action would be taken in accordance with law.

4. Recording the submissions made by learned counsel appearing on either side, without expressing any opinion on the merits of this case, this writ petition is disposed of with consent directing the respondent Nos.3 & 4 to consider the representation of the petitioner dated 03.01.2026 and pass appropriate orders strictly in accordance with law, within a period of three (03) weeks from the date of receipt of copy of this order.

Miscellaneous applications, if any pending, shall stand closed.

No order as to costs.
