A petition for pre-arrest bail may be disposed of when the State formally submits that no complaint has been filed and no criminal case has been registered against the petitioner.

Headnote:The petitioner sought pre-arrest bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, alleging a reasonable apprehension of arrest for a non-bailable offence in an unregistered crime intended to harass him. The court examined the submissions of both the petitioner and the respondent-State. The primary issue was whether the petitioner was entitled to pre-arrest bail. The court noted the submission of the Additional Public Prosecutor that no complaint had been filed against the petitioner at the relevant police station and no case had been registered. : ORDER :

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of pre-arrest bail to the petitioner for the un-registered Crime.

2. Heard Ms. Verose Sanjana, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for respondent-State.

3. Learned counsel appearing for the petitioner submitted that petitioner is going to implicate in a Criminal Case to harass him. She further submitted that there is a reasonable apprehension that the petitioner may be arrested on an accusation of having committed a non-bailable offence and prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition.

4. On the other hand, learned Additional Public Prosecutor, on instructions, submitted that there is no such complaint given against the petitioner herein in Inavole Police Station nor any case is registered against him.

5. Recording the said submissions, this Criminal Petition is disposed of.

Miscellaneous applications, if any pending, shall stand closed.
