JUDGMENT:

This appeal is filed by the appellant-claimant challenging the order and decree dated 28.06.2013 passed in M.V.O.P.No.1035 of 2010 by the Chairman, Motor Accidents Claims Tribunal-cum-IV Additional District Judge (FTC), Khammam (for short “the Tribunal”), whereby the Tribunal dismissed the claim petition.

2. The brief facts of the case are that on 27.04.2009, Vanga Adinarayana (hereinafter referred to as “the deceased”) boarded an auto-rickshaw bearing registration No.AP 5 TU 1781 proceeding towards Danavaipeta and when it reached near Chodipallypeta Village, the driver drove the vehicle in a rash and negligent manner without taking minimum care and caution and applied sudden brakes. As a result, the deceased fell on the road, sustained grievous injuries. He was immediately shifted to Government Hospital, Kakinada, where he was declared dead.
