IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
N. Tukaramji, J
I Krishna Murthy – Appellant
Versus
The State of Telangana – Respondent
CRIMINAL PETITION No.13602 OF 2024
For the Appellants/Petitioners:
For the Respondents: Additional Public Prosecutor
A petition seeking quashment of criminal proceedings is rendered infructuous when the trial court concludes the proceedings in acquittal during the pendency of the petition.
Headnote:The petitioners filed a petition under S. 528 of the Bharatiya Narik Suraksha Sanhitha, 2023, seeking the quashment of proceedings in C.C.No.11874 of 2021 for offences punishable under S. 506 of the Indian Penal Code. It was observed that during the pendency of the petition, the trial court had already considered the matter on merits and acquitted the petitioners on 17.03.2025. The court addressed whether the petition for quashment remained viable given the trial outcome. The court reasoned that since the trial had ended in acquittal, the grievance of the petitioners had been effectively redressed, and nothing further remained for adjudication. Accordingly, this criminal petition is dismissed as infructuous.
