CRIMINAL PETITION No.13639 OF 2024
For the Appellants/Petitioners:
For the Respondents: Additional Public Prosecutor
A petition for quashment of proceedings is rendered infructuous when the underlying trial court proceedings are dismissed, as the primary grievance of the petitioner is effectively redressed.
Headnote:The petitioners filed a petition under S. 528 of the Bharatiya Narik Suraksha Sanhitha, 2023, seeking the quashment of proceedings in D.V.C.No.43 of 2023, which were registered for offences punishable under Sections 18, 19, 20, and 22 of the Protection of Women from Domestic Violence Rules. The petitioners were arrayed as respondents in the said domestic violence case. The court considered the submission that during the pendency of the petition, the trial court had already dismissed the matter as not pressed on 20.02.2026. Consequently, the court found that the grievances of the petitioners had been effectively redressed, rendering the current petition unnecessary for adjudication. Accordingly, this criminal petition is dismissed as infructuous.
