IN THE HIGH COURT FOR THE STATE OF TELANGANA

AT HYDERABAD

THE HONOURABLE SRI JUSTICE N.V.SHRAVAN KUMAR

WRIT PETITION No.6365 of 2026

DATE OF ORDER: 02.03.2026

Between:

Kasarla Prabakar Reddy, S/o. Ram Reddy

...Petitioner

AND

The State of Telangana,

Rep. by its Principal Secretary,

Municipal Administration & Urban Development

Department,

Secretariat, Hyderabad & 3 Others

...Respondents

ORDER:

This writ petition is filed questioning the action of respondent

Nos.2 and 3 in not considering the petitioner’s representation dated

05.12.2025. A consequential prayer is sought to direct respondent

Nos.2 and 3 to consider the said representation.

2. Learned counsel for the petitioner submits that the petitioner is

a senior citizen and claims to be the owner of the house property

bearing H.No.2-7-720, Central Excise Colony, Subedari,

Hanumakonda, which was purchased by way of a registered sale deed

bearing document No.3543 of 1974, dated 25.09.1974 registered at

Joint Sub-Registrar Officer, Warangal. After obtaining permission

from Warangal Municipal Corporation vide permission dated

18.01.1978, the petitioner constructed the house in his plot within the

boundaries of his plot and has constructed a compound wall within

the boundaries as specified in the sale deed of layout plot. It is

further submitted that land of respondent No.4 – The Officers’ Club,

Hanumakonda, is situated on the southern side of the petitioner’s

property. Subsequently, some laborers engaged by respondent No.4

entered into the petitioner’s property without issuing any prior notice

and demolished the petitioner’s compound wall. The petitioner also

requested the Secretary of respondent No.4 Club to stop the

demolition, but the respondent No.4 is going ahead with the

construction without looking into the documents of title in respect of

the petitioner’s property. Aggrieved by the action of respondent No.4,

the petitioner made a representation to respondent No.2 – The

Commissioner, Greater Warangal Municipal Corporation (for short

“GWMC”) requesting to take action against the illegal construction

being undertaken by respondent No.4. But till date, no action has

been initiated. Questioning the same, the present writ petition is filed.

3. Learned counsel for the petitioner further submits that since

petitioner’s representation dated 05.12.2025 is still pending for

consideration, the respondent authorities may be directed to consider

the same and take action in a time bound period.

4. On the other hand, learned counsel appearing on behalf of Mr.

Pasham Mohith, learned Standing Counsel for GWMC, submits that

the petitioner’s representation dated 05.12.2025 will be considered, if

not already considered, and appropriate action would be initiated, in

accordance with law, and prays this Court to pass appropriate orders.

5. Mr. M.Sahas Reddy, learned Assistant Government Pleader for

Revenue takes notice on behalf of respondent No.3.

6. Heard learned counsel for the petitioner and learned counsel

appearing for respondent No.2 and perused the material made

available on the record.

7. Since this Court, time and again, directed the Municipal

Authorities to initiate action against the illegal constructions by

following due process of law, it is noticed that the authorities are

failing to initiate action against the illegal constructions. However, in

some of the cases, authorities are issuing statutory notices and

thereafter not proceeding further to initiate further course of action

unless writ petitions are filed for not considering complaints/

representations made to civic authorities.

8. It is not out of place to mention Section 7(6) of the Telangana

State Building Permission Approval and Self Certification System (TS-

bPASS) Act, 2020 (for short ‘the TS-bPASS Act’) and Section 174(5) of
