ORDER

This Contempt Case is filed alleging non-compliance of the order

dated 20.02.2025 passed by this Court in Writ Petition No.5183 of

2025.

2. This Court vide order dated 20.02.2025 disposed of

W.P.No.5183 of 2025, with the following directions:

“6. In view of the above submissions, this Court, deems it appropriate to

dispose of the writ petition permitting the petitioner to submit an application

by duly enclosing all the necessary documents as required under Section 6

of the Act, within a period of fifteen days from the date of receipt of a copy of

this order, for granting succession certificate and for consequential mutation

of her name in the revenue records and issuance of pattadar passbook. In

the event if the petitioner submits an application fulfilling all the

requirements mentioned in CCLA’s circular No.1 of 2021, dated 15.01.2021

and Circular No.1 of 2024, dated 28.02.2024, respondent No.4 is directed to

consider the said application, after issuing notices to the petitioner and all

the interested/concerned parties and if the petitioner is otherwise not

eligible, pass a reasoned order within a period of three (3) months from the

date of receipt of a copy of this order and communicate the same to the

petitioner.”

3. Learned Assistant Government Pleader for Revenue appearing for

the respondents has submitted that in pursuance of the orders dated

20.02.2025 passed by this Court in W.P.No.5183 of 2025, the

respondents have examined the application of the petitioner and the

same was rejected by the respondent No.2 vide Proceedings

No.E/Bhubharathi/24/2026 dated 02.01.2026. A copy of the said

proceedings is placed on record.

4. The relevant portion of the said proceedings reads as follows:

“On verification of documents, based on the Tahsildar, Ghanpur proceeding

No.B/457/2025, Dt.06.01.2026 and reasons explained, considering the

objections vide ref.4 & 5, the land in land in 97/అ/3 to an extent of Ac.2.30

Gts., situated within the limits of Ghanpur Village of Ghanpur Mandal

Application No.2500618358 for succession is hereby Reject.”

5. In view of the above, it cannot be held that the respondents have

willfully or deliberately disobeyed the order of this Court so as to invoke

the provisions of the Contempt of Courts Act, 1971.

6. Accordingly, this Contempt Case is closed. However, if the

petitioner is aggrieved by the proceedings dated 02.01.2026, she is at

liberty to challenge the same before appropriate forum, in accordance

with law, if so advised.

Miscellaneous petitions, if any, shall stand closed.
