COMMON JUDGMENT: (per Hon’ble Justice Gadi Praveen Kumar Since, these appeals arise out of common order passed in the Writ Petitions, they are being heard and disposed of by this common judgment.

2. Heard Sri D.Jagan Mohan Reddy, learned counsel for the appellants and Sri Jalli Kanakaiah, learned Senior Counsel assisted by Sri Jalli Narendar, learned counsel appearing for respondent Nos.6 - 10.

3. Both these Appeals are filed assailing the common order dated 23.09.2025 passed by a learned Single Judge of this Court in W.P.Nos.19917 and 20263 of 2021 in dismissing the Writ Petitions as arbitrary.

The appellants filed W.P.No.19917 of 2021 seeking to declare the order dated 08.02.2021 passed by the Special Tribunal, Yadadri- Bhuvanagiri District in Special Tribunal Case No.F2/2522/2021, as arbitrary, with a consequential direction to the Revenue Authorities to continue the name of appellant No.2 in the Revenue Records in respect of land admeasuring Ac.1-39 gts in Sy.No.283/F by duly amending the Revenue Records as maintained in Dharani Portal and issue new e-Pattadar Pass Book to appellant No.2 for the said land.

Similarly, the appellant in W.A.No.1389 filed W.P.No.20263 of 2021 seeking to declare the order dated 16.06.2021 passed by the Special Tribunal, Yadadri-Bhuvanagiri District in Special Tribunal Case No.F2/1817/2021 as well as the Memo No.B/2134/2019 dt.04.03.2020 and the Succession Order passed in File No.A/3413/2008 dated 22.10.2009 issued by the respondent No.5-Tahsildar in favour of the unofficial respondents therein in respect of the land admeasuring Ac.2.00 gts in Sy.No.283 situated at Bommalaramaram village and Mandal, Yadadri- Bhuvanagiri District as arbitrary, with a consequential prayer to set aside the same and amend the Revenue Records and issue new e-Pattadar Pass Book to the appellant in respect of the land admeasuring Ac.1-39 gts in Sy.No.283/F situated at Bommalaramaram village and Mandal, Yadadri-

Bhuvanagiri District.

The facts leading to the filing of Writ Petitions are that the appellants’ father viz Bandla Narasaiah had purchased the lands admeasuring Ac.5-00 gts in Sy.No.283/A, Ac.1-00 gts in Sy.No.283/B, Ac.4-15 gts in Sy.No.283/D, Ac.4-35 gts in Sy.No283/E and Ac.1-39 gs in Sy.No.283/F, totaling Ac.17-09 gts situated at Bommalaramaram village and Mandal from Uppala Chandra Reddy and others during the year 1960 through a simple Sale Deed and since the date of purchase, appellants’ father was in possession of the lands and after his death, the appellants are in continuous possession of the said lands.

It is the case of the appellants that they approached the landlords for execution of registered sale deed in respect of the property, and when the pattadars did not cooperate for execution of registered sale deed, the appellants filed O.S.No.85 of 1986 on the file of the District Munsif Judge at Bhuvanagiri for declaration of title in respect of the suit schedule property admeasuring Ac.17-09 gts against the pattadars, and basing on the consent statement of the pattadars in their written statement, O.S.No.85 of 1986 was decreed on 01.05.1986 declaring the appellants as the absolute owners and possessors of the schedule land and, ordered the District Collector to rectify the revenue records, who in turn directed the authorities to mutate the names of the appellants in the revenue records as pattadars and possessors, that the names of the appellants are incorporated in the revenue records even in the Faisal Patti of the year 1986-87, and that the land admeasuring Ac.11-09 gts was mutated in the name of appellant No.2 i.e. Bandla Ramulu and land admeasuring Ac.6-00
