THE HONOURABLE SRI JUSTICE C.V. BHASKAR REDDY
The Managing Director – Appellant
Versus
Nenavath Ravi – Respondent
MACMA 1211/2019
IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD THE HON’BLE SRI JUSTICE C.V.BHASKAR REDDY M.A.C.M.A.No.1211 of 2019 DATE: 26.02.2026 Between:
The Managing Director, Andhra Pradesh State Road Transport Corporation, Musheerabad, represented by its Regional Manager, Sangareddy. …..Appellant AND Nenavath Ravi ….Respondent
JUDGMENT
This appeal is filed by the appellant/RTC challenging the award dated 31.07.2015 passed in M.V.O.P. No. 626 of 2011 by the Chairman, Motor Accidents Claims Tribunal-cum-V Additional District Judge at Sangareddy (for short “the Tribunal”), whereby the Tribunal awarded compensation of Rs.7,50,000/- for the injuries sustained by the respondent-claimant in a motor vehicle accident occurred on
13.01.2008.
2. Heard the submissions of learned counsel for both sides and perused the record.
3. Learned Standing Counsel for the appellant/RTC contended that the Tribunal erred in holding that there was no negligence on the part of the claimant–motorcyclist. It is further contended that the claimant failed to implead the owner and insurer of the motorcycle as parties to the claim petition, and therefore the petition is liable to be dismissed for non-joinder of necessary parties. He also submitted that, as per Ex.A.1–FIR and Ex.A.2–Charge Sheet, the accident occurred in the opposite direction, indicating contributory negligence on the part of the claimant, and therefore prayed to set aside the order and decree of the Tribunal.
4. On the other hand, learned counsel for the respondent-claimant contended that the Tribunal, after considering the oral evidence of PWs.1 to 3 and the documentary evidence marked as Exs. A1 to A9, rightly concluded that the accident occurred due to the rash and negligent driving of the RTC Bus bearing No. AP 10 Z 2782. It is submitted that the quantum awarded is just and reasonable and that no interference is required by this Court in the well-reasoned order passed by the Tribunal.
5. As seen from the material on record, the accident occurred on 13.01.2008 when the RTC bus, driven at high speed in a rash and negligent manner, dashed against the claimant's motorcycle. The Police, Sangareddy Rural, registered a case in Crime No.11/2008 and filed a charge sheet against the driver of the RTC bus. Although the appellant pleaded contributory negligence, they did not adduce any rebuttal evidence to disprove the testimony of PW.1 or the contents of the police reports. Regarding the quantum of compensation, the evidence of PW.2 and PW.3, supported by Ex.A9 Disability Certificate, confirms that the claimant suffered an above-knee amputation of the right leg, resulting in 85% permanent physical disability. The Tribunal assessed the claimant's income at Rs.3,000/- per month and correctly applied a multiplier of 18, given the claimant's age of 22 years. The total compensation of Rs.7,50,000/-, which includes amounts for medical expenses, pain and suffering, and loss of future earnings, is based on a proper perspective of the evidence. This Court finds no illegality or infirmity in the impugned award. Hence, the appeal is devoid of merits and liable to be dismissed.
6. In the result, this appeal is dismissed. No order as to costs.
As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
