JUDGMENT:

Sri S. Sridhar, learned counsel appears for appellant/writ petitioner.

Sri Mahesh Raje, learned Government Pleader for Home appears for respondent Nos.1 to 3.

Sri N. Bhujanga Rao, learned Deputy Solicitor General of India, appears for respondent Nos.4 and 5.

2. The instant Writ Appeal was preferred against the order dated 06.01.2026 passed by the learned writ Court in Writ Petition No.25501 of 2025 refusing to interfere in the matter. The appellant has sought declaration that the action of respondent No.3 in harassing him to apply for long term visa else they would initiate prosecution, is illegal. The learned writ Court in the operative part of the order under appeal observed as under:

“In view of the above, this Court is of the considered view that petitioner has not made out any case. However, since it is stated in the counter as well as in the written instructions filed by the 3^rd respondent, that as per the Government Order dated 28.04.2025 all the Pakistani nationals holding LTVs and not obtained an Indian citizenship shall apply afresh for LTVs and both petitioner and his mother applied for LTVs in July 2025, respondents are directed to consider the same and pass appropriate orders in accordance with the guidelines issued in that regard, as early as possible.

With the said direction, the Writ Petition is disposed of.

No costs.”

3. When the matter was taken up on 11.02.2026, after hearing the learned counsel for the parties, learned Government Pleader for Home and learned Deputy Solicitor General of India were granted time to seek instructions after impleading the passport authorities.

4. The matter was taken up yesterday when learned counsel for the appellant produced a photo copy of a document said to be a passport issued in the name of the appellant. The same is placed on record.

5. On the other hand, the learned Government Pleader for Home produced a copy of the letter dated 05.07.2025 authored by Mr. Syed Ali Hussain Razvi (Imran) seeking long term visa. The matter was adjourned for today to enable the learned counsel for the appellant to seek instructions.

6. Today, the learned Deputy Solicitor General of India has produced a letter dated 03.10.2025 addressed by the Office of the Regional Passport Officer, Hyderabad, to the Inspector of Police, Office of the Inspector of Police, Pakistan Branch, SB City, Hyderabad, C/o Old Commissioner of Police, Hyderabad, to the effect that as per the details furnished, no passport details could be retrieved from their database in respect of Mrs. Gohar Fatima and her son, Mr. Imran Hussain Abid @ Styed Ali Hussain Razvi, Indian Origin Pakistani National.

7. The learned counsel for the appellant has again reiterated that the appellant is in possession of the passport.

8. However, after some arguments, the learned counsel for the appellant seeks permission of this Court to withdraw this appeal.

9. The learned counsel for the respondents do not object to it.

Accordingly, the instant Writ Appeal is dismissed as withdrawn. The respondents are at liberty to take appropriate steps in accordance with law. There shall be no order as to costs.

Miscellaneous applications, if any pending, shall stand closed.
