ORDER
This Writ Petition is filed seeking the following relief:
“to issue writ or order or direction, more so in the nature of Writ of Mandamus in declaring the collective actions of respondents more specifically Respondent Nos.2 and 3 in disqualifying the Petitioner Company in the tender bearing Tender No. STN- 1482/25 floated by Respondent No.2 by merely stating ‘NOT QUALIFIED’ without assigning any rhyme or reason despite being eligible, thereby putting Petitioner Company to irreparable loss, financial injury and in utter deliberate violation of doctrine of legitimate expectation, principles of natural justice which is subject matter of this writ petition, as mala fide, arbitrary, illegal, dereliction of duty, against the terms and conditions of tender and violation of the fundamental rights of the Petitioners, more particularly Articles 14 and 19(1)(g) of the Constitution of India and consequently after setting aside the action of Respondent No. 2 in deliberately disqualifying Petitioner Company from the tender bearing Tender No. STN-1482/25 thereby direct Respondent Nos.2 and 3 to reconsider the bid by giving Petitioner Company a fair opportunity to participate in the tender bearing Tender No.STN-1482/25 as it has requisite eligibility criteria and pass”.
2. Heard Sri Pramod Kumar, learned counsel for the petitioner, learned Government Pleader for Energy appearing for respondent No.1 and Sri N.Sreedhar Reddy, learned Standing Counsel for TGSPDCL appearing for respondent Nos.2 and 3.

The petitioner has been prevented from participating in the tender process for supply of three phase (10-40)A Electronic Energy Meters DLMS and IRDA Port without Box Meters, on the sole ground of being blacklisted by Dakshinanchal Vidhyuth Vithran Nigam Ltd. The petitioner submitted that the blacklisting order was set aside by the High Court of Allahabad with a direction to conduct fresh enquiry as on the date of issuance of the tender notice. The petitioner was no longer blacklisted and was eligible for participating in the tender process. While so, respondent Nos.1 to 3 have erroneously debarred the petitioner from participating in the tender process.
4. When this matter was heard on 20.02.2026, there was ambiguity about whether fresh enquiry was concluded or not and whether the blacklisting order was still in force or not.
5. This Court passed an order to that effect that in case the bid was not finalized as on 20.02.2026, the bid may not be finalized.
6. The petitioner has produced communication dated 21.02.2026 from DVVNL, wherein it is reported that the departmental proceedings against the petitioner’s firm are currently being conducted in accordance with the prescribed departmental guidelines and there is no blacklisting or debar in force on the petitioner as on 20.02.2026. Even so, respondent Nos.1 to 3 have on the mistaken premise about the blacklisting of the petitioner, concluded the bid and awarded the same in favour of respondent Nos.4 and 5.
7. In view of the same, the Writ Petition is disposed of directing respondent Nos.1 to 3 to permit the petitioner to participate in future bids without reference to the disqualification by DVVNL. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this petition, shall stand closed.
