O R D E R:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:

“…to issue a Writ, Order or Direction, especially one in the nature of WRIT OF MANDAMUS declaring the action of Respondent No.3 in not conducting investigation by registering the crime against the Respondents 5 and 6 as per the complaint lodged by the Petitioner on 14.09.2019 as illegal, arbitrary, violative of Articles 14, 21 and 300-A of the Constitution of India and consequently direct the Respondent No.3 to register a crime against the Respondents 5 and 6 and investigate into the matter and take appropriate action in accordance with law and pass such order or other orders…”

2. I have heard Mr. A. Ravinder Reddy, learned Senior Counsel for the petitioner; Mr. D. Pradeep, learned Assistant Government Pleader for Home, appearing on behalf of respondent Nos. 1 to 3; Mr. V.Aishwaary Kumar, learned counsel for respondent No. 4 and Ms. V. Chitralekha, learned counsel, representing Mr. Vedula Srinivas, learned counsel for respondent No. 5.

3. Learned Senior Counsel for the petitioner submits that respondent No. 3 failed to register a crime and conduct a proper investigation based on the petitioner’s representation dated 14.09.2019, and therefore the present writ petition has been filed seeking appropriate directions.

4. Learned Assistant Government Pleader for Home, on instructions, submits that the representation of the petitioner was duly acted upon by registering F.I.R. No. 214 of 2019. It is further submitted that, upon completion of the investigation, a final report was filed on 30.01.2021 before the learned IV Additional Chief Metropolitan Magistrate, Hyderabad, referring the case as “Mistake of Fact.” In view of these developments, it is contended that the grievance raised by the petitioner no longer survives for consideration, and accordingly dismissal of the writ 5. Learned counsel appearing for respondent Nos. 4 and 5 submits that the allegations made by the petitioner in the writ petition are unfounded and devoid of substance. On that basis, dismissal of the writ

6. I have perused the material available on record.

7. The substance of the petitioner’s grievance is that the police failed to register a crime based on his representation. However, the developments reported by the learned Assistant Government Pleader for Home indicate that a crime was in fact registered pursuant to the said representation, investigation was conducted, and a final report was thereafter filed before the competent Magistrate. In view of the aforesaid factual position, it is evident that the grievance of the petitioner has been duly addressed by the respondent police authorities. Consequently, no further adjudication or direction is warranted in the present writ proceedings.

8. Accordingly, while reserving the liberty of the petitioner to avail the remedies available under law before the concerned Magistrate against the said final report, if so advised and if the cause still subsists, this Writ Petition is disposed of. There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
