ORDER

This Writ Petition is filed seeking the following relief:

“...issue an appropriate Writ more in the nature of Writ of Mandamus declaring the action of the Respondent No.2, the Commissioner, Municipal Corporation, Karimnagar in not canceling the building permission granted in favour of the 3rd Respondent herein vide Permit No. G2/ 527/ 2013 in File No.96/2013-2014, dated 25.07.2013, pursuant to the representation made by the Petitioner hereon on 21.09.2013, as being highly arbitrary, illegal, malafide, motivated, unconstitutional and motivated on extraneous considerations and offending Articles 14, 19 (1) and 21 of the Constitution of India and consequently direct the Official Respondents to forthwith cancel the building permission vide Permit No. G2/ 527/ 2013 in File No.96/2013-2014 dated 25.07.2013 issued in favour of the 3rd Respondent for raising the structures in and over all that open plot measuring 242. 00 sq. yards in survey No.77, situated at Kisan Nagar, Karimnagar and issue such other writ or order or direction as deemed fit and proper in the circumstances of case.”

2. Mr.P.Vamsheedhar Reddy, learned counsel for the petitioner seeks permission of this Court to withdraw the Writ Petition with liberty to file fresh petition at an appropriate time.

3. Permission is accorded.

4. Mr.K.Siddarth Reddy, learned Standing Counsel for Karimnagar Municipal Corporation appearing for respondent No.2 takes no objection to the same.

5. Therefore, the Writ Petition is dismissed as withdrawn granting liberty as sought for. There shall be no order as to costs.

Miscellaneous petitions, pending if any, shall stand closed.
