Heard learned counsel for the petitioner, Sri Putta Krishna Reddy, learned Standing Counsel for Municipal Administration and Urban Development appearing for respondent No.1, learned Assistant Government Pleader for Revenue appearing for respondent Nos.2 & 3 and Sri Madhusudan Reddy, learned counsel appearing for respondent Nos. 4 & 5. With the consent of the parties, the writ petition is being taken up for disposal.

2. This writ petition has been filed seeking the following prayer:-

“to issue a Writ, order or orders more particularly a Writ of Mandamus, declaring the inaction of the 2 to 5 respondents in not stopping the illegal construction made by the 7th Respondent in Plot No.27B part “Padmasree Enclave”, admeasuring 229.67 Sq yards equivalent to 192.03 Sq.meters in Gundlapochampally circle, GHMC, despite the representations dated 17.12.2025, 19.12.2025 and

27.01.2026 as arbitrary and illegal, violates the Principles of Natural Justice and against the Articles 14 and 300-A of Constitution of India and consequently direct the respondents 2 to 5 to revoke the permit 494746/GUDL/0089/2025 in Plot No.27B part “Padmasree Enclave”, admeasuring 229.67 Sq Yards equivalent to 192.03 Sq.meters in Sy.No.151 and 152 situated at Kandlakoya village, now Gundlapochampally circle, GHMC and take action against the other order or orders.”

The case of the petitioner is that the 7th respondent is making illegal construction without following the mandatory building rules and in deviation of the sanctioned building permission bearing No. 494746/GUDL/0089/2025 in Plot No.27B (Part), “Padmasree Enclave”, admeasuring 229.67 square yards equivalent to 192.03 square meters in Survey Nos.151 and 152 situated at Kandlakoya Village, presently falling under Gundlapochampally Circle, GHMC. It is further submitted that the said construction is being carried out in violation of the sanctioned plan and the statutory provisions governing building construction. It is further submitted that the petitioner, being affected by the said illegal construction, made representations dated 17.12.2025, 19.12.2025 and 27.01.2026 to respondent Nos.2 to 5 requesting them to take appropriate action and to stop the unauthorized construction being carried out by the 7th respondent. However, despite receipt of the said representations, the respondent authorities have not taken any action so far. Aggrieved by the action of the respondent authorities in not considering the petitioner’s representations and not taking steps to stop the illegal construction, the present writ petition is filed.

Learned Standing Counsel appearing for respondent Nos.4 and 5, on instructions submits that the representations of the petitioner dated 17.12.2025, 19.12.2025 and 27.01.2026 would be considered and that appropriate notice would be issued to respondent Nos.6 and 7 and after issuance of notice appropriate steps would be taken in accordance with law.

It is not out of place to mention Section 7(6) of the Telangana State Building Permission Approval and Self Certification System (TS-BPASS) Act, 2020 (for short ‘the TS-BPASS Act’) which also encourages citizens to put on notice to the Civic Authorities regarding unauthorized constructions. Section 7(6) of the TS-BASS Act is extracted for reference.

“7. Approval of Building Permissions-

(6) Citizens shall be encouraged to bring to the notice of Municipality and District Collector cases where unauthorized construction or construction in violation of or in excess of permissions, in the manner prescribed.
