ORDER:
The present writ petition is filed seeking the following prayer:
“It is hereby prayed that this Hon’ble Court may be pleased to issue an appropriate Writ, order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondents Nos.2 and 3 in construction of the committee hall in the land earmarked for park in the layout approved vide L.P.No.138/89 in Survey No.701/1 at Chintalkunta/Lingambagh colony, Gadwal Municipality, Gadwal, as highly illegal, arbitrary, unjust and irrational and consequently direct the respondents to develop the land earmarked for park into a park only but not otherwise and pass such other order or orders may deem fit and proper in the circumstances of the case.”

When the matter is taken up for hearing, learned counsel for the petitioner contends that the land vide L.P.No.138/89 in Survey No.701/1 at Chintalkunta/Lingambagh colony, Gadwal Municipality, Gadwal is admittedly earmarked for park in the approved layout. In view of the various judgments of this Courts Hon’ble Division Bench as well as this Court, there cannot be any construction in the area specifically earmarked for park in the said layout vide L.P.No.138/89 in Survey No.701/1 at Chintalkunta/Lingambagh colony, Gadwal Municipality, Gadwal.
3. Learned Standing Counsel for respondent Nos.2 and
3 submits that, as on today, no construction is being carried out in the subject land for the purpose of committee hall. He further submits that though some construction had previously been commenced, the same has since been demolished and the park area has been restored.
4. In view of the above submission, the Writ Petition is hereby closed. It is made clear that respondent Nos.2 and 3 are not permitted to construct in the area or space which is clearly earmarked for park.
5. Accordingly, the Writ Petition is closed. There shall be no order as to costs.
Miscellaneous applications, pending if any, shall stand closed.
