CRLP 14532/2024

IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD THE HONOURABLE SRI JUSTICE N.TUKARAMJI CRIMINAL PETITION No.14532 OF 2024

19th February, 2026 Between:

Mohammed Ghouse …Petitioner/Accused AND The State of Telangana and Another …Respondents

ORDER:

This Criminal Petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhitha (for short ‘BNSS, 2023) seeking quashment of the proceedings against the petitioner/accused in C.C.No.515 of 2024 on the file of the learned Principal Judicial First Class Magistrate at Mahabubabad.

2. Heard Mr. P.Vishnuvardhana Reddy, learned counsel for the petitioner, Mr.M.Vivekananda Reddy, learned Additional Public Prosecutor appearing for the respondent No.1-State and Mr.Gajanand Chakravarthu, learned counsel for respondent No.2.

3. The petitioner is arrayed as accused in C.C. No. 515 of 2024 and is facing trial for offences punishable under Sections 354(A), 354(D), 354, 294(B) of the Indian Penal Code.

4. Learned counsel for the petitioner submits that, although the petitioner has a strong case even for seeking quashment of the proceedings, he is willing to face trial. However, the requirement of his personal appearance on every hearing date is causing significant hardship and is adversely affecting his respective occupation and pursuits. He therefore prays that the petitioner be exempted from personal appearance except when specifically required by the Court, contending that such a direction would adequately address his grievance.

5. The learned Additional Public Prosecutor states that he has no specific objection to the said prayer, but seeks a direction requiring the petitioner to appear in person at the material stages of the proceedings. 6. Upon considering the submissions of both parties, and subject to the condition that the petitioner/accused shall be represented by his counsel at every adjournment and shall appear in person whenever directed by the Court, the personal appearance of the petitioner/accused in the proceedings in C.C. No.515 of 2024, pending before the learned Principal Judicial First Class Magistrate at Mahabubabad, is hereby dispensed with. It is made clear that any failure to comply with these conditions shall render this order ineffective.

7. With this direction, this Criminal Petition is disposed of.

Miscellaneous petitions, pending if any, shall stand closed.
