ORDER:

This Writ Petition is filed with the following relief:

“….to issue a writ or direction more particularly one in the nature of writ of mandamus, declaring the action of the Respondents No.3 in seizing the stocks of the petitioner in respect of MKB Tobacco Zarda each 14 Grams tins with MRP Rs.16/ 11 cottons each containing Tins 2388 was seized on 09-07- 2015, without following the due procedure on Regulation of FSS Act, 2006 is illegal, arbitrary and violation of principles of natural justice, consequently direct the 3rd respondent to release the seized stocks of the petitioner in respect of MKB Tobacco Zarda each 14 Grams tins with MRP Rs.16/- 11 cottons each containing 200 Tins, total 2200 Tins and another one cotton containing 188 Tins, Grand total Tins 2388 was seized on 09-07-2015 on furnishing bank guarantee for the value of the stock, forth with, and pass….”

2. Heard Mr.K.Srinivas, learned counsel for the petitioner and Mr.R.Laxmikanth Reddy, learned Assistant Government Pleader for Home.

The brief facts of the case are that petitioner is involved in selling and the Tobacco products and the respondent No.3 has seized the said Tobacco products from the possession of the petitioner on 09.07.2015. The seized stock contains MKB Tobacco Zarda each 14 Grams tins with MRP Rs.16/- of 11 cottons each containing 200 Tins total 2200 Tins and one cotton containing 188 Tins, total tins of 2388.

Learned counsel for the petitioner further submitted that the petitioner got permission from concerned Department for sale of Tobacco and Tobacco products, Sugar, Fire Works, Kirana, Groceries in wholesale from manufacturing places namely Lucknow, Bombay, Hyderabad and the petitioner is selling the same in retail at Karimnagar under valid bills and maintaining books of accounts evidencing the sale and purchase of the said products and they are being inspected by the authorities concerned.

Learned counsel for the petitioner would submit that the petitioner has also filed a Writ Petition No.14348 of 2015 before this Court as the respondents are interfering with his business and this Court vide order dated 14.05.2015 directed the respondents No.2 and therein not to interfere with the peaceful business of the petitioner in Tobacco and Tobacco products, Sugar, Fire Works, Kirana/Groceries permitting the petitioner to continue the business and also directed the authorities for taking action according to law. He further stated that the petitioner is having license which is renewal from time to time and the petitioner never contravened the regulation from the Act. Hence prayed for passing appropriate orders.

Learned Assistant Government Pleader for Home would submit that respondent No.3/the Food Safety Officer seized the stock of MKB Tobacco product/Zarda and sent for analysis under the provision of Food Safety and Standards Act. As per analysis report No.406 of 2015- 16 dated 29.07.2015, the said samples contains nicotine and violating the regulations 2.3.4 of FSS regulation and also sale of which is prohibited in the State for a period of one year with effect from

10.01.2015.

7. I have perused the materials on record.

8. As per the record, on 09.07.2025, the respondent No.3/the Food Safety Officer found that the petitioner is running general stores and selling tobacco products banned by the Government. Accordingly, the respondent No.3 apprehended the petitioner and seized tobacco products MKB Tobacco Zarda each 14 Grams tins with MRP Rs.16/- of 11 cottons each containing 200 Tins total 2200 Tins and one cotton containing 188 Tins, total tins of 2388.
