ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Municipal Administration and Urban Development appearing for respondent No.1 and Sri.P.Krishna Reddy, learned standing counsel for Municipality appearing for respondent No.2. With their consent, the writ petition is being taken up for disposal at the admission stage itself.

2. This writ petition has being filed seeking the following prayer:-

“to declare the action of the 2nd respondent in revoking the Building Permission obtained by petitioner vide Permit No.442797/POCH/0622/2024 dated 15.01.2025 by order in Proceedings No.MCP/G1/TPS/36/2025-2026 dated 13.11.2025 purportedly U/S 176(9) of the Telangana Municipality Act, 2019 on the representation made by Respondents Nos.3 to 5 is illegal, arbitrary and violative of provision of Telangana Municipalities Act, 2019 and without Authority and in violation of Articles 14 and 21 of Constitution of India and set aside the same by consequently direct the Respondent No.2 herein to restore the Building Permission granted in favour of the Petitioner.”

Brief facts as stated in this writ petition are that the petitioner is a bank employee and claims to be the owner and possessor of Plot No.35, admeasuring to an extent of 200 Sq.yards (167.22 Sq.Meters), in Sy.No.20-part, situated at Pocharam Village and Municipality, Ghatkesar Mandal, Medchal Malkajgiri District, having acquired the same through registered sale deed bearing document No.10141 of 2023 dated 16.10.2023. It is submitted that the petitioner under staff loan scheme availed house loan for purchase and construction of the subject property and after purchasing the subject property, the petitioner on 19.10.2024, applied for building permission and vide proceeding in Permit order No.442797/POCH/0622/2024 dated 15.01.2025, permission was granted to the petitioner to construct Stilt for parking + two upper floors on the subject property. Thereafter, the petitioner without making any deviation to the sanction plan commenced construction in the month of July, 2025 on the subject property. The case of the petitioner is that on complaint from respondent Nos.3 to 5, respondent No.2 issued show cause notice bearing No.G1/36/POCH/2025 dated 22.08.2025, alleging that the petitioner had misrepresented the actual facts while obtaining the building permission and directed the petitioner to show cause within (15) days why the building permission shall not be cancelled, failing which necessary action will be initiated as per the available records and Section 174, 176(9) of the Telangana Municipalities Act, 2019. Thereafter, the petitioner on 03.09.2025 made a reply to the show cause notice dated 22.08.2025, however, the respondent No.2 issued impugned order under Section 176(9) of the Telangana Municipalities Act, 2019 bearing order No.MCP/G1/TPS/36/2025- 2026 dated 13.11.2025, wherein it is stated that the respondent Nos.3 to 5 in their complaint dated 27.06.2025 informed that there is ongoing legal dispute with respect to the subject property and the matter is sub judice before the learned Principal District and Sessions Judge-cum-Family Court, Medchal- Malkajgiri District (herein after referred as ‘the trial Court’) and enclosed a copy of I.A.No.3345 of 2024 in O.S.No.1250 of 2014. It is further stated that since the petitioner by misrepresenting the material fact obtained the building permission vide file No.442797/POCH/0622/2024 dated 15.01.2025, the same is revoked and stands cancelled. Aggrieved by the impugned revocation order bearing order No.MCP/G1/TPS/36/2025-2026 dated 13.11.2025, this writ petition is filed.
