ORDER:

Heard Sri Sai Prasen Gundavaram, learned Counsel for the petitioners and Sri P.Sri Harsha Reddy, learned Standing Counsel for Singareni Collieries Company Limited, appearing for the respondents. Perused the material on record.

2. Learned Counsel for the petitioners submits that this Writ Petition is filed seeking to declare the office order issued vide by the respondents Ref.CRP/PER/IR/C/081 dated 25.04.2023, as illegal, arbitrary and consequently to direct the respondents to treat the petitioners’ candidature for medical invalidation as of July 2021.

Learned Counsel for the petitioners submits that the petitioner No.1 was appointed as a Badli Worker on 01.06.1987, posted as Trammer in RKP.1A incline, Mandamarri Area (underground), Mancherial District in 2017 and is due for retirement on 29.02.2024. During employment, the petitioner No.1 fell ill, applied to the Corporate Medical Board (for brevity, “CMB”) for declaration of unfitness, underwent examination on 11.11.2021 at Main Hospital, Kothagudem and was declared fit for the same job. On 29.11.2021, the petitioner No.1 suffered chest pain, was referred from Ramakrishnapur Area Hospital to Virinchi vide Hospital letter No.RKP/MED/A11/D036/11872 dated 29.11.2021. Meanwhile, he was declared fit for the same job vide order Ref.MMR/PER/E/175/ 21/7546 dated

06.12.2021.

4. Learned Counsel for the petitioners further submits that, on 06.12.2021, the petitioner No.1 was admitted to Virinchi Hospital, CAG on 07.12.2021 revealed double vessel disease, followed by PTCA and stenting on 09.12.2021 and discharged on 11.12.2021 with review advised.

5. Learned Counsel for the petitioners further submits vide that, on 17:01.2022, Ref.No.RKP/MED/C/001/580, the petitioner No.1 was referred to Main Hospital, Kothagudem, for General Physician’s fitness advice, noting sick rolls from vide

29.07.2021. On 19.01.2022, Ref.No.CRP/MED/C/049/623, the petitioner No.1 was referred to NIMS for Cardiologist and Neurologist attention. Referred again on 08.02.2022, the Main Hospital issued vide proceedings Ref.No.CRP/MED/C/049/1388 dated 15.02.2022 advising application to Corporate Medical Board via proper channel, HPL till CMB and sick list continuance.

6. Learned Counsel for the petitioners further submits that the petitioner No.1 applied to Corporate Medical Board on 23.02.2022. As there was no response, he addressed a letter dated 20.10.2022 to the Corporate Medical Board to examine his case to call him for medical examination. The petitioner No.1 was directed to report at CMO, S.C. Main Hospital, Kothagudem, along with the treatment papers, for arranging medical examination by the Corporate Medical Board, vide scheduled to be held on 24.03.2023 and 25.03.2023 proceedings in Ref.No.MMR/RK1A/G012/23/689 dated 23.03.2023. The Medical Board examined the petitioner No.1 on 25.03.2023 at Singareni Collieries Main Hospital, Kothagudem and upon physical examination and review of medical reports, he was diagnosed with Type 2 Diabetes Mellitus (DM), Coronary Artery Disease (CAD) status post Coronary Angiogram-Double Vessel Disease (s/p CAG-DVD), status post Percutaneous Transluminal Coronary Angioplasty (s/p PTCA) Stent to Posterior Descending Artery (PDA) with good Left Ventricular (LV) function, and seizure disorder. Consequently, the Board declared him medically unfit for underground duties but fit to work as General Mazdoor on surface level. Pursuant thereto, the office order was issued vide Ref.No.CRP/PER/IR/C/081 dated 25.04.2023 stating that the petitioner No.1 was medically unfit for underground work and fit to work as General Mazdoor on surface level and directing him to report to the General Manager, MMR, fo
