ORDER

This writ petition is filed seeking the following prayer:

“…to declare the action of the 2nd respondent in allowing the illegal and unauthorized constructions being carried out by the unofficial respondent in the agricultural land belongs to the petitioner even without conversion of land from Agricultural to Non-agriculture in Sy.No.515 in an extent of Ac.7-32gts situated at Amistapur Village, Bhoothpur Mandal, Mahabubnagar District as illegal, arbitrary, unconstitutional and violation of principles of natural justice and consequently direct the respondents No.2 to remove the illegal and unauthorized cons ruction being carried out by the unofficial respondent in the above mentioned land in accordance with law and to pass…”

Heard learned counsel for the petitioner, learned Assistant Government Pleader for Municipal Administration appearing for respondent No.1 and Sri Putta Krishna Reddy, learned Standing Counsel for Municipality appearing for respondent No.2. With their consent, this writ petition is taken up for disposal at the admission stage itself.

Learned counsel for the petitioner submits that the petitioner is the absolute owner and possessor of land admeasuring Ac.7.32 guntas in Survey No.515, situated at Amistapur Village, Bhoothpur Mandal, Mahabubnagar District. A Pattadar Pass Book bearing No.85874, Patta No.184 was duly issued in favour of the petitioner, and his name has been recorded in the pahanis and other relevant revenue records. It is further submitted that certain land disputes arose between the petitioner and one B. Raja Shekar Reddy and others. In that regard, the petitioner instituted a suit in O.S. No.60 of 2014 on the file of the learned II Additional District and Sessions Judge (FTC), Mahabubnagar, seeking declaration and perpetual injunction. The trial Court was pleased to grant temporary injunction against the defendants therein, and the said suit is presently pending adjudication.

While the matter stood thus, the unofficial respondent began interfering with the peaceful possession and enjoyment of the subject land and threatened the petitioner with dire consequences. The unofficial respondent also commenced formation of a layout and raised constructions over the subject property without obtaining necessary NALA permission and building permission from the competent municipal authorities. In these circumstances, the petitioner issued a legal notice dated 21.01.2026 to respondent No.2, bringing to his notice the illegal and unauthorized layout and construction activities and requested him to furnish details of the requisite permissions obtained from the Municipality. Despite receipt of the said notice, respondent No.2 failed to respond. Thereafter, on 22.01.2026, the petitioner submitted another representation reiterating the earlier grievances and requested the authorities to take immediate action for removal of the illegal and unauthorized constructions being carried out by respondent No.3. Upon receipt of the representation, the subordinates of respondent No.2 initially stopped the construction activity and cautioned the unofficial respondent not to proceed further. However, notwithstanding such intervention, the unofficial respondent continued with the construction activities. Aggrieved by the same the present writ petition is filed.

Learned Standing Counsel for the Municipality, appearing for respondent No.2, submits that upon receipt of the notice dated 21.01.2026, respondent No.2 will examine the same and take appropriate action in accordance with law.
