Heard Mr. Vivek Jain, learned counsel for petitioners and Mr. Srinivas Rao Pachwa, learned Standing Counsel for GHMC for respondent No.1, and Mr. J.Teja Varma, learned counsel for respondent No.5.

The instant writ petition has been filed declaring the inaction of the respondent No.1 pursuant to representation dated 01.07.2014 of the petitioners in removing the encroachments on a public road, as arbitrary and unjust and consequently, to direct the respondent No.1 to remove the illegal structures raised by the respondent Nos.2 to 6 over 25 feet public road connecting Nacharam to NFC Road to the property of the petitioners.

The brief facts of the case are that petitioner No.1 is a registered company, initially incorporated in Hyderabad Vanaspathi Limited and later it changed to Venkateswara Edusupport Limited, and owned land admeasuring Acs.16.20 guntas in Sy.Nos.617/1, 2, 3, 4, 6, 7 and 13 adjacent to Telephone Exchange, Malkajgiri Village and Mandal, Ranga Reddy District, having acquired the same through Certificate of Sale in various company applications and agreement of sales from its predecessors in title and petitioner No.2 entered into lease agreement with the petitioner No.1 apart from having purchased a house property from the petitioner No.1. Further, it is stated that petitioner No.2 is running a School in the above mentioned land under the name and style ‘Delhi Public School’ since 2005 and that construction was done by the petitioners in accordance with the sanctioned plan and the said land over which a School is being run has ingress and egress on two sides, one access is situated on the Eastern side of the property connecting the main road running between Nacharam and NFC, while the other road is connecting on a 40 feet road, connecting Nacharam to Manikchand Roller Flour Mills. 4. It is further submitted that while things stood thus, the respondent Nos.2 to 6 without any manner of right or claim or interest over the said property, started interfering with usage of the said road on the Eastern side of the property by obstructing the buses, two wheelers and cars of the petitioner-school from using the road and thereby creating a disturbing atmosphere. Aggrieved by the action of the respondent Nos.2 to 6, the petitioners filed a suit in O.S.No.67 of 2013 on the file of Additional Junior Civil Judge, Ranga Reddy District for perpetual injunction and other reliefs along with the interlocutory application in I.A.No.239 of 2013 for the relief of temporary injunction and the trial Court was pleased to grant temporary injunction restraining the respondent Nos.2 to 6 from interfering with the usage of the road vide order dated 03.06.2014, which is still in force as on date of filing of the writ petition.

Further, it is contended that respondent Nos.2 to 6 do not have any manner of right to obstruct or cause any interference on a 25 feet public road, connecting 80 feet Nacharam to the School of the petitioners and the respondent Nos.2 to 6 are the residents of adjoining colony, called as ‘Singam Cheruvu Thanda’ and there is an existing 80 feet wide rod from Nacharam to NFC, which is connected to the school of the petitioners on the Eastern side of its property through a 25 feet road laid by the Municipality. It is stated that respondent Nos.2 to 6 would also have to use the same 25 feet rod to access their colony and as such, there cannot be any doubt or ambiguity about the existence of 25 feet road on the Eastern side of the petitioners-school and that the responde
