This Writ Petition is filed seeking the following relief:- “…to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of respondent No.3 in not registering the Petitioner’s Complaint, dated 05.07.2025 which sent through courier by the Petitioner, as illegal, arbitrary and against the principles of natural justice and direct Respondent No.3 to register the Petitioner’s Representation, dated 05.07.2025 as F.I.R. which is sent through courier by the Petitioner and take all necessary action including the registration of an F.I.R…”

2. Heard Sri P.Giri Krishna, learned counsel for the petitioner and Sri M.Srinivas, learned Assistant Government Pleader for Home appearing for the respondents and with their consent, this writ petition is being taken up for disposal at the admission stage.

Learned counsel for the petitioner would submit that the marriage of the petitioner was performed with one Andoji Vandana on 24.12.2020, as per the Hindu Rites and Customs and they lived happily for some time at Alwal. Subsequently, the petitioner had sponsored the Visa for Andoji Vandana to U.S.A. as dependant. In the meantime, the relations between the petitioner and his wife had become strained. Further, the wife alleged about the petitioner’s sexual impotency. On 05.02.2021 the petitioner had filed F.C.O.P.No.975 of 2021 under Section 12 (i) (a) of the Hindu Marriage Act before the Additional Family Court, Ranga Reddy District at L.B.Nagar, to declare his marriage with his wife as null and void and the said O.P. is pending. Meanwhile, without obtaining any legal divorce, his wife had changed her surname from Kanaparthi Vandana to Andoji Vandana and obtained a new passport bearing No.V69073498 with the said name. Subsequently, the wife obtained F1 student visa to go to U.S.A. in August, 2023, sponsored by Mr.Noulla Naga Chary. It is alleged that she had eloped with the said Mr.Noulla Naga Chary by marrying him and they were blessed with a male child at Pomona Valley Hospital, California. As the wife of the petitioner married the said N.Naga Chary during subsistence of her marriage with him and also during pendency of the F.C.O.P., the petitioner made a complaint before respondent No.3 on 05.07.2025. As respondent No.3 did not register the said complaint, he made an application under the provisions of the Right to Information Act, 2025 vide application, dated 18.08.2025 and acting on the said application, respondent No.3 gave a reply stating that the said Andoji Vandana is residing at U.S.A. and as such, the alleged offence occurred outside the territorial jurisdiction of India and therefore, the complaint lodged by the petitioner cannot be registered. It is further stated that, if the petitioner appears in person at the police station and files a complaint, appropriate action could be taken.

4. Learned counsel for the petitioner would further submit that respondent No.3 failed to follow the provisions of Sections 188 and 189 of Cr.P.C. analogous to Sections 208 and 209 of B.N.S.S. He would further submit that the petitioner has been subjected to continuous harassment by the said Andoji Vandana by initiating multiple frivolous and vexatious proceedings amounting to abuse of process of law. Acting on the complaints lodged by Andoji Vandana, Crime Nos.602 of

2021 and 236 of 2022 were registered against the petitioner and his family members and after completion of investigation, the police filed charge sheets, which were numbered as C.C.No.9172 of 2021 and C.C.No.2179 of 2022 on the file of the V Additional Metropolitan Magistrate, Ranga Reddy District at L.B.Na
