IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD THE HONOURABLE SRI JUSTICE N.V.SHRAVAN KUMAR WRIT PETITION No.2502 of 2026 Date: 12.02.2026 Between:

Guduri Gopala Ranga Raju.

…Petitioner AND The State of Telangana, Rep. by its Principal Secretary, Municipal Administration and Urban Development Department, Secretariat, Hyderabad and two others.

…Respondents

ORDER

Heard Mr. V.V.Satish, learned counsel for the petitioner;

learned Assistant Government Pleader for Municipal Administration and Urban Development appearing for respondent No.1; learned Standing Counsel for HMDA appearing for respondent No.2; learned Assistant Government Pleader for Irrigation and Command Area Development appearing for respondent No.3 and perused the material on record. With their consent, this Writ Petition is being taken up for disposal at the stage of admission itself.

2. This writ petition is filed seeking the following prayer:-

“...declaring the action of the respondents in interfering with petitioner’s land admeasuring Ac.8-10 guntas in Sy.No.385 and Ac.9-25 guntas in Sy.No.384 of Puduru Village, Medchal Mandal, Medchal-Malkajigiri District though the alleged Pandula Kunta land admeasuring Ac.2-08 guntas is not situated within the land of the petitioner and the said extent is available separately on ground, as illegal, arbitrary and violation of Article 14, 21 and 300-A of the Constitution of India and to consequently direct the respondents not to interfere with the land of the petitioner and to pass...”

3. Brief facts of the case as stated are that the petitioner claims to the absolute owner and possessor of the land admeasuring Ac.5.00 guntas in Survey No.384/1, Ac.9.20 guntas in Survey No.384/2/1, total extent of Ac.14.20 guntas and Ac.3.10 guntas in Survey No.385/AA/1 and Ac.5.00 guntas in Survey No.385/AA/2, total extent of Ac.8.10 guntas situated at Puduru Village, Medchal Mandal, Medchal-Malkajigiri District. Originally, the subject lands were purchased by petitioner’s father, one late Sri Guduri Gopala Krishna Raju, through a registered sale deed vide document No.856 of 1979 dated 04.05.1979 and by petitioner’s grandmother, one late Smt.G.Suramma, through a registered sale deed vide document No.1706 of 1981 dated 27.04.1981. After the death of petitioner’s father on 07.04.2012, the properties were partitioned under a registered partition deed vide document No.5625 of 2016 dated 12.08.2016. In the said partition, the land admeasuring Ac.8.10 guntas in Survey No.385 and Ac.5.00 guntas in Survey No.384 fell into petitioner’s share and by virtue of Will Deed dated 26.11.1998, the petitioner’s grandmother executed the land admeasuring Ac.14.20 guntas in the petitioner’s favour and after the death of his grandmother, the rights over the land devolved upon him. Out of the total extent, the petitioner gifted the land admeasuring Ac.5.00 guntas for his elder brother and Ac.4.35 guntas for development. Presently, the petitioner is in possession of the land admeasuring Ac.9.25 guntas in Survey No.384 and Ac.8.10 guntas in Survey No.385. In 2019, the respondents visited the land in Survey No.385 and alleged that the land admeasuring Ac.2.08 guntas in Survey No.385 belongs to Pandula Kunta pursuant to the survey dated 15.07.2019. However, the said extent was never part of their purchase, as Survey No.385 corresponds to old Survey No.305 wherein the petitioner’s father purchased only to an extent of Ac.18.10 guntas out of Ac.20.26 guntas. Despite no notice or allegation of encroachment, the respondents are interfering with the petitioner’s land and restraining development. Aggrieved by the same, the present writ petition is filed.

4. Learned Standing Counsel for HMDA appearing for respondent No.2 submits that they are not interfering with the possession of the petitioner and if respondent No.2’s interference is warranted, they will follow due procedure as contemplated under law.

5. Learned Assistant Government Pleader for Irrigation and Command Area D
