ORDER:
The petitioner assails the proceedings dated 09.09.2004 issued by respondent No.2 – Suryapet Municipality. By the impugned proceedings, the 2nd respondent granted permission to respondent No.3 – M/s. Indus Towers Limited to install a Telecommunication Infrastructure Tower (TIT) on the existing commercial building, G + 1 floor, bearing Nos. 1-4-263, 264 and 265, situated at Kudakuda Road, Suryapet.
2. It is the specific case of the petitioners that the premises, where the telecommunication tower is permitted to be installed is situated in a thickly populated residential zone, and that the harmful radiation enumerating from telephone towers would adversely affect the health and lives of the residents of the locality.
3. When the matter is taken up for hearing, Sri Yogesh A.N. Tuljapurkar, learned counsel submits that the counsel on record, Sri K. Narasimha Chary, expired on 05.10.2025.
4. Heard Sri Yogesh A.N Tuljapurkar, learned counsel for the petitioner and Sri A. Rohith Singh, learned counsel representing Sri Mohd. Islamuddin Ansari, learned counsel for respondent No.3. Perused the record.
5. Both the learned counsels submit that the issue involved in the present writ petition is squarely covered by the orders passed by this Court in W.P. Nos. 21976 and 29401 of 2016, dated 29.01.2026, and therefore, similar orders may be passed in this writ petition also.
6. Considering the respective submissions, it is to be noted that this Court disposed of the writ petitions, W.P.Nos.21976 and 29401 of 2016 by order dated 29.01.2026 with the following direction:-
“8. In that view of the matter, it would suffice to direct the GHMC to issue appropriate directions to M/s.
Ascend Telecom Infrastructure Pvt. Ltd. to upgrade its technology in accordance with the new emerging standards being followed in the recent past, so as to reduce radiation levels and to ensure that there are no health hazards to the local inhabitants.”
7. Accordingly, the Writ Petition is disposed of, directing the GHMC to issue appropriate directions to respondent No.3 – M/s. Indus Towers Limited to upgrade its technology in accordance with the new emerging standards being followed in the recent past, so as to reduce radiation levels and to ensure that there are no health hazards to the local inhabitants. It is needless to mention that the GHMC shall address a letter to the Telecom Enforcement, Resource and Monitoring Cell of the Department of Telecommunications, Government of India, with a request to accord permission to respondent No.3 – M/s. Indus Towers Limited to upgrade to new technology, in the interest of respondent No.3 and the local inhabitants, so as to reduce radiation. There shall be no order as to costs.
Miscellaneous petitions, if any are pending, shall stand closed.
