This writ petition is filed seeking the following relief:

“ …. to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus and Declaration and Declare the e-Tender notification dated 18.08.2025 issued by the Respondent No.2 insofar as tender is issued for Stall No.OS-28, 10x10 size Mahabubnagar Bus Station and Depot despite the allocation of the said Stall by virtue of contract by Respondent No.3 dated 18.06.2024 and letter dated 29.08.2025 as illegal, arbitrary, contrary, violative of Articles 14, 19(1)(g) and 299 of the Constitution of India and

consequently, direct the Respondent Nos.1 and 2 to allot

petitioner Stall No.OS-28, 10x10 size Mahabubnagar Bus

Station and Depot by taking the amount and pass…….”

2. Heard Sri Baglekar Akash Kumar, learned counsel for

the petitioner and Smt. N.S.V.Janaki, learned counsel

representing Sri R. Anurag, learned standing counsel for the respondent Nos.1 and 2. Perused the record.

3. The case of the writ petitioner is that stall number OS-28 10x10 size, Mahabubnagar Bus Station and Depot has been allotted by respondent Nos.2 and 3 to one V. M.Sateesh to sell Vijaya Dairy products vide order dated 13.05.2019 for a total period of five years. Said V.M.Sateesh was selling non-Vijaya Dairy products and therefore, his allotment has been cancelled by respondent No.3 vide order dated 18.06.2024. Thereafter, respondent No.3 allotted the said stall to the petitioner vide allotment letter bearing No.675/GM (Mkt)/2012, dated 18.06.2024 for a period of six months subject to deposit of Rs.25,000/- in February 2024 and processing fee of Rs.1,000/-. Aggrieved by the order passed by the respondent No.3, V.M. Sateesh filed W.P.No.18531 of 2024. The writ petitioner got herself impleaded by filing an interlocutory application in W.P.No.18531 of 2024. The writ petition No.18531 of 2024 has been allowed vide order dated 23.12.2024 by setting aside the cancellation order dated 18.06.2024 on account of non- issuance of a prior show cause notice to V.M.Sateesh before cancellation i.e. on account of violation of principles of natural justice. Aggrieved by the same, the writ petitioner herein filed Writ Appeal No.57 of 2025 before a Division Bench of this Court and said Writ Appeal was dismissed by order dated 27.01.2025. The writ petitioner submits that she has paid amount to respondent No.3 but is unable to operate the stall. On account of non-compliance to the principles of natural justice by respondent No.3, the petitioner is suffering. The respondent Nos. 2 and 3 have orally assured the writ petitioner that once the term of V.M.Sateesh is over, Stall No. OS-28 would be allotted to the petitioner and therefore, she is waiting with legitimate expectation for allotment of the stall subsequent to completion of term of V. M. Sateesh. Immediately after the term of V.M.Sateesh was terminated, she approached respondent No.2 to allot Stall No.OS-28, whereas, respondent No.2 issued e-Tender notification dated 18.08.2025 including the Stall No.OS-28. The petitioner has paid amount in the year 2024 itself and is therefore under legitimate expectation of allotment of the Stall. When respondent No.2 issued e-Tender notification, left with no option, the writ petition has been filed.

4. The respondent Nos.1 and 2 opposed the petitioner's claim, questioning her locus standi on account of non-existence of privity of contract between the writ petitioner and TSRTC. The respondent Nos.1 and 2 pleaded that e-Tender process is adopted for bidding and allotment of stalls in a fair and transparent manner.
