ORDER:

This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief:-

“…to issue Writ, or Order or direction more particularly one in the nature of Writ of Mandamus, directing the respondents not to demolish petitioner’s H.No.1-8-69/A, together with Post Office, situated at Golconda Street, Medak town and District, under the guise of road widening, deviating from the Centre Point of old road by declaring the proceedings No.C/236/2002-15, dated 21.07.2015, on the file of 2^nd respondent, as arbitrary, illegal and violativce of Article 14, 300-A of the Constitution of India..”.

petitioner; Sri Putta Krishna Reddy, learned Standing Counsel and learned Assistant Government Pleader for the respondent No.3. Perused the record.

3. When the matter is taken up for hearing, learned Standing Counsel along with the learned Assistant Government Pleader for respondent No.3 would contend that as on today, there is no proposal for road widening as alleged by the petitioner.

4. In view of the above, the Writ Petition is disposed of, directing respondent Nos.1 to 3 to initiate proceedings under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, in the event of they proceeding with the road widening affecting the subject property of the petitioner, issue notice to the petitioner and other affected parties, and take possession of the property after paying compensation in accordance with the provisions of the said Act. There shall be no order as to costs.

Miscellaneous petitions, if any are pending, shall stand closed.
