ORDER :

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

“….to issue a Writ of Mandamus or any other appropriate writ, order or directing the respondent police authorities to forthwith expedite the investigation in Crime No.148 of 2025 on the file of Central Crime Station, DD, Hyderabad and to take all necessary effective and lawful steps for tracing seizure and recovery of the stolen gold ornaments weighing about 550 grams belonging to the petitioner.…”

2. Heard Mr. Mohammed Abdul Wahab, learned counsel for the petitioner; Sri M.Srinivas, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 3 and with their consent, this writ petition is being taken up for disposal at the admission stage.

Learned counsel for the petitioner submits that acting on the complaint of de facto complainant, a case in Crime No.148 of 2025 dated 12.11.2025 was registered by respondent No.3 for the offences punishable under Sections 316(2), 318(4) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023. Learned counsel for the petitioner further submits that the accused in the said crime collected old gold ornaments from several persons including from the petitioner herein and despite lapse of three months from the date of registration of crime, no steps have been taken by the respondents for conducting investigation, therefore prays this Court to direct the respondents to conduct investigation into the said crime as expeditiously as possible.

Mr. M.Srinivas, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 3 on instructions would submit that based on a complaint lodged by de facto complainant, a case in Crime No.148 of 2025 was registered for the offences punishable under Sections 316(2), 318(4) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023. Learned Assistant Government Pleader further submits that the respondent authorities are making sincere efforts for collecting all the required evidence by conducting investigation in transparent, fair and proper manner with a view to recover the misappropriate gold ornaments.

5. Having regard to the submissions of both the learned counsel and on perusal of the material available on record, this writ petition is disposed of directing the respondent authorities to conduct investigation into the said crime as expeditiously as possible by following due process of law.

There shall be no order as to costs.

As a sequel, miscellaneous petitions, if any, pending, shall stand closed.
