This Writ Petition is filed under Article 226 of

Constitution of India seeking the following relief:-

“…to issue Writ, order or direction preferably one in

the nature of Writ of Mandamus declaring the action

of the 2nd respondent in not initiating steps

pursuant to the representation of the Petition dated

18.08.2014 and RTI Application dated 03.01.2015

as illegal, arbitrary, violative of principles of natural

justice and consequently, direct the 2nd respondent

to demolish the construction made by the

Respondents 3 & 4 illegal, and pass such other

order or orders…”

2. Heard Sri M.V. Hanumantha Rao, learned counsel for the

petitioner and Sri Putta Krishna Reddy, learned Standing

Counsel for Municipality, appearing for respondent No.2.

Perused the record.

3. The grievance of the petitioner is that respondent Nos.3

and 4 are constructing the house without a valid permission

granted by the respondent No.2-Municipality and that the said

construction is not in accordance with the sanctioned plan and

the said house is being constructed illegally. Though a

representation was made to the respondent on 18.08.2014, no

action has been taken.

4. Learned Standing Counsel would contend that they

would consider the representation made by the petitioner by

following due process of law and that they shall take

appropriate action.

5. Per contra, learned counsel for respondent Nos.3 and 4

would contend that the said house is being constructed in

accordance with the sanctioned plan.

6. In the aforesaid circumstances, the Writ Petition is

disposed of, directing the respondent No.2 to take appropriate

action on the representation made by the petitioner dated

18.08.2018, by following due process of law.

Miscellaneous petitions, if any are pending, shall stand

closed.

The grievance of the petitioner is that respondent Nos.3 and 4 are constructing the

house with a valid permission given by the respondent No.2-Municipality and that

the said facts as per the sanction plan has not been followed and illegally the said

house has been constructed. Though a representation has been made to the

respondent on 18.08.2014, they are not conducted any action. 4. Learned Standing

Counsel Sri Putta Krishna Reddy would contend that they would consider the

representation made by the petitioner by following due process of law and they shall

take appropriate action. 5. Per contra, learned counsel for respondent Nos.3 and 4

would contend that the said house is being constructed in accordance with the

sanctioned plan. 6. In these circumstances, the Writ Petition is disposed of, directing

the respondent No.2 to take appropriate action and the representation made by the

petitioner dated 18.08.2018 by following due process of law. dont change the tone
