Heard learned counsel for the petitioner and learned

Assistant Government Pleader for Revenue.

2. Learned Assistant Government Pleader for revenue, on the basis of written instructions, submitted that an oral complaint was received from the villagers that the petitioner is erecting a shed in Sy.No.168, which is a Government land, instead of Sy.No.167/B. The petitioner owns land in Sy.No.167/B of Kothagattu Village and he obtained NALA permission for an extent of Ac.0.05 guntas. The respondent No.3 conducted enquiry on the complaint of the villagers with the help of field staff i.e. Mandal Revenue Inspector,

Mandal Surveyor and Grama Palana Adhikari and it was ascertained that the petitioner erected shed in Sy.No.168, which is a

Government land.

3. It is further submitted that the petitioner taking advantage of his possession in Sy.No.167/B, which is adjacent to the Government land in Sy.No.168, encroached the Government land. The respondent No.3 directed the field staff to remove the encroachment in the Government land in Sy.No.168 duly following due procedure and issuing notice and giving sufficient time to the petitioner to remove encroachment on his own. The petitioner filed O.S.No.25 of 2026 before the Junior Civil Judge – cum – Judicial

First Class Magistrate, Parkal, Hanumakonda District.

4. Learned Assistant Government Pleader for Revenue submitted that survey was conducted pursuant to notice dated 22.11.2025 in Rc.No.B/756/2025 issued to Macharla Rajaiah, son of the petitioner. Subsequently, proceedings were initiated for eviction of the petitioner under the provisions of the Land Encroachment Act, 1905 and order dated Nil.02.2026 was passed in proceedings No.B/756/2025 directing M. Rajesh to remove the illegal

encroachment on the Government land in Sy.No.168.

5. In view of the above proceedings and the submissions of the learned Assistant Government Pleader for Revenue that notice will

be issued to the petitioner and due process of law will be followed to remove the illegal encroachment, the writ petition is disposed of with a direction to the respondents No.3 and 4 to follow due

process of law, in case, the petitioner is so far not evicted.

The miscellaneous applications, pending if any, shall stand closed. There shall be no order as costs.
