This writ petition is filed by the petitioner challenging the proceedings No.E1/2843/2023 dated 28.09.2024 issued by respondent No.2 whereby his request to remove the land admeasuring Acs.2-00 guntas in Survey No.191/29/AA, situated at Kollur Village, Ramachandrapuram Mandal, Sanga Reddy District (for short ‘subject land’) from the prohibitory list of properties has been rejected.

2. Heard Mr. N.Bhujanga Rao, learned counsel for the petitioner; Ms. R.Snehitha Reddy, learned Assistant Government Pleader for Assignment, appearing for the respondents; and perused the material on record.

3. The petitioner claims to be the owner and possessor of agricultural land admeasuring Acs.2-00 guntas in Survey No.191/29/AA, situated at Kollur Village, Ramachandrapuram Mandal, Sanga Reddy. That originally, the petitioner purchased the land admeasuring Acs.5-09 guntas in Survey No.191 under the following sale deeds as mentioned below:

(i) land admeasuring Ac.0-20 guntas in Survey No.191 under registered sale deed bearing document No.1123 of 1994 dated 31.03.1991 from Mr. N.Kumara Swamy and Mr. B.Yohan through their G.P.A. holder by name Mr. Kamlesh Lohade and Mr. R.Arun Kumar.

(ii) land admeasuring Acs.2-09 guntas in Survey No.191 under registered sale deed bearing document No.1122 of 1994 dated 31.03.1994 from Mr. Vijaya Rao through his GPA holder Mr. Kamesh Lohada and Mr. R.Arun Kumar.

(iii) land admeasuring Acs.2-20 guntas in Survey No.191 under registered sale deed bearing document No.455 of 1996 dated 25.01.1996 from one Ms. Putcha Vijaya Lakshmi, who in turn purchased the same from one Mr. Abdul Hafeez under registered sale deed bearing document No.3968 of 1992 dated 21.10.1992.

It is submitted that the original vendors under the aforesaid sale deeds viz., Mr. N.Kumara Swamy, Mr. D.Vijaya Rao and Mr. Abdul Hafeez, were ex-servicemen and the then Government of Andhra Pradesh assigned the above lands to them under the ex-servicemen category in 1972. These ex-servicemen sold away the assigned lands long after their assignment to meet their family necessities. The ex-servicemen are entitled to sell their lands after a period of ten (10) years from date of assignment as per G.O.Ms. No.1117 Revenue (Assignment) Department dated 11.11.1993. It is submitted that the petitioner had been in possession and enjoyment of the above lands right from the date of purchase. As the petitioner intended to sell the lands in 2007, he was informed that No Objection Certificate (NOC) is required from the District Collector, Sanga Reddy (respondent No.2 herein), as such, he approached respondent No.2 for issuance of NOC. Respondent No.2 issued memo No.D1/1578/07 dated 04.07.2007 intimating that no sales are permitted since the lands were given under regular assignment, therefore, “No Objection Certificate cannot be granted”. Challenging the said memo, the petitioner filed W.P. No.25273 of 2007 before the erstwhile High Court of Andhra Pradesh and the same was allowed by the order dated 18.02.2009 setting aside the memo dated 04.07.2007 and the Sub-Registrar, Sanga Reddy was directed to register the documents submitted by the petitioner. It is submitted that after the sale of the lands to third parties, the petitioner was left with the subject land. It is further submitted that respondent No.3, vide Lr. No.B1/3606/2009 dated 29.12.2009 addressed to Sub-Registrar Sanga Reddy, clearly stated that the subject land is ex-servicemen land and that the petitioner purchased from them.

5. Learned counsel for the petitioner submitted that after introduction of Dharani, the petitioner applied
