ORDER

This Writ Petition is filed seeking the following relief:- “…to issue any writ, order or direction more particularly one in the nature of Writ Of Mandamus declaring the action of the Respondents in not closing Rowdy Sheet against the Petitioner pending before the Respondent No.5 Kanchanbagh Police Station, Hyderabad inspite of representation dated 05.06.2024 made by the Petitioner as illegal, arbitrary and against the principles of natural justice and in violation of Articles 14 and 21 of the Constitution of India besides violation of this Hon’ble Court directions and consequently direct the Respondents to close the Rowdy Sheet against the Petitioner and not to interfere into the Petitioners life and liberty …”

2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing for the respondents. Perused the record.

3. Learned counsel for the petitioner would submit that the petitioner hails from respectable family and he is a law abiding citizen and he is eeking out his livelihood as a Cab driver in Ola. Learned counsel for the petitioner would further submit that in view of registration of a case against the petitioner vide Crime No.259 of 2020 of Chatrinaka Police Station for the offences punishable under Sections 302, 148, 120-B of Indian Penal Code read with 149 of Indian Penal Code and Section 25(1)(B) of Arms Act, 1959, a rowdy sheet/surveillance sheet has been opened against him. It is the further case of the petitioner that, after completion of investigation, charge sheet was laid in the said crime and the same was numbered as P.R.C.No.544 of 2024 on the file of learned Chief Metropolitan Magistrate, Hyderabad. Even after opening rowdy sheet, the petitioner has committed another officer in Crime No.110 of 2021 on the file of Kanchanbagh Police Station, dated 09.06.2021 for the offences under Sections 379, 411 of Indian Penal Code and the same was compromised in Lok Adalat on 02.11.2023. While it is so, another crime in Crime No.147 of 2024 under Section 80 read with Section 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances, Act, 1985 of Chandrayangutta Police Station, dated 16.04.2024 and the said case is pending for Trial.

3.1. The main grievance of the petitioner is that as on today, there is only two cases pending against the petitioner herein. However, without considering the said fact and also the procedure laid down under the A.P.Police Manual, the respondents have issued the above said rowdy sheet against the petitioner herein and they are continuing the same which is arbitrary, illegal and also contrary to the principles laid down by the Hon’ble Apex Court and this Court in catena of decisions. Learned counsel would further submit that under the guise of opening and continuation of rowdy sheet, the respondents-police are calling the petitioner to the police station and harassing him by making him to wait in the police station for hours together. With the said submissions, learned counsel for the petitioner sought a direction to the respondents to close the above said rowdy sheet opened against the petitioner.

A counter affidavit is filed by respondent No.4 stating that, in view of the involvement of the petitioner in Crime No.259 of 2020 for serious offences, the Police, Chatrinaka Police Station, Hyderabad, has opened a rowdy sheet against him vide No.56/OW/DIVN-FN/2021, dated 01.01.2021. Learned Assistant Government Pleader for Home, on instructions, would submit that, as of now two cases are pending against the petitioner and he also seeks to pass appropriate orders.

5. Maintenance of rowdy sheets is governed by Standing Order No.601 of A.P.
