This Criminal Petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) by the petitioners, who were arrayed as accused Nos.1 to 4, seeking to quash the proceedings in C.C. No.325 of 2024 on the file of Judicial Magistrate of First Class, Andole at Jogipet, Medak District, for the offences punishable under Sections 447, 427, 341, 323 and 504 r/w 34 of the Indian Penal Code, 1860 (for short ‘IPC’).

2. Heard Mr.Palle Sriharinath, learned counsel for the petitioners, Mr.Koppula Gopal, learned counsel for respondent No.2 and Mr.Jithender Rao Veeramalla, learned Additional Public Prosecutor, appearing on behalf of respondent No.1-State.

3. Brief facts of the case:

On 28.01.2024 at about 13-00 hours, respondent No.2/de-

facto complainant, lodged a written complaint stating that he owns agricultural land admeasuring Ac.1.00 gts, in Sy.No.248 situated at the outskirts of Keroor village. On 27.01.2024, he irrigated and cultivated the said land with a tractor. On 28.01.2024 at about 11-30 hours, while his son Sai Datt and tractor driver Krishna were preparing the land for paddy cultivation, petitioners came to the field, obstructed the agricultural work, and damaged the water supply pipes. When respondent No.2 questioned their actions, petitioner Nos. 1 and 2 abused him in filthy language. During the course of the incident, petitioner Nos.3 and 4 beat his son and pushed respondent No.2 to the ground by holding his collar. The accused persons also criminally intimidated them with threats to kill. It is further alleged that accused No.1 locked the house, which had earlier been locked by respondent No.2. Based on the said complaint, Crime No. 08 of 2024 was registered for the offences under Sections 447, 427, 341, 323, 504 and 506 read with 34 IPC. After completion of investigation, the Investigating Officer filed a Final Report before the Judicial First Class Magistrate, Medak District. The learned Magistrate took cognizance of the offences under Sections 447, 427, 341, 323 and

504 read with 34 IPC.

4. Submissions of the learned counsel for the petitioners:

4.1 Learned counsel submitted that the petitioners have not committed any offence and they were falsely implicated in this case. The allegations made in the complaint are purely civil in nature, in respect of agriculture land and the ingredients of the offences under Sections 447, 427, 341, 323 and 504 read with 34 IPC are not attracted. Respondent No.2 without having any manner of right and interest over the subject property filed the complaint by giving it a criminal colour.

4.2 He further submitted that the petitioners are owners of the subject property and when respondent No.2 and others are trying to interfere with the subject property, petitioner No.2 and another filed a suit in O.S.No.94 of 2023 on the file of the Senior Civil Judge, Sangareddy, wherein the said Court granted status quo in I.A. No.621 of 2023 on 27.04.2023 and the said status quo order is in existence. Respondent No.2 is claiming rights over the subject property basing upon the wrong revenue entries made in his favour. The petitioners lodged a complaint before the revenue authorities and basing on the said complaint, the District Collector, Sangareddy vide letter dated 29.09.2022 directed the Tahsildar, Vatpally Mandal, Sangareddy District, to conduct enquiry and submit the report.
