This writ petition is filed seeking a writ of mandamus to direct the respondent Nos.2 to 4 to remove illegal encroachment on the public path and illegal construction of the building without leaving any set backs and occupying 3 feet public road and also consider the petitioner representations dated 29.12.2025 and 06.02.2026.

2. Learned counsel for the petitioner submits that the petitioner is a resident of Gokul Enclave Apartment, situated at North HAL Colony, Gajularamaram, Jeedimetla, Medchal–Malkajgiri District. It is further submitted that respondent No.4 has undertaken illegal construction of a building in Plot No. 969/part, Survey No. 219, located at North HAL Colony, Jeedimetla, Hyderabad, which property belongs to respondent No.5 and is situated opposite to the petitioner’s apartment, namely Gokul Enclave Apartment. Learned counsel for petitioner contends that the said construction is being carried out in violation of GHMC norms and without obtaining the requisite permissions. It is alleged that respondent No.4 has encroached upon approximately 3 feet of the public road and has raised the construction without leaving the mandatory setbacks as required under the applicable building regulations. It is further submitted that the petitioner submitted representations dated 29.12.2025 and 06.02.2026 to the concerned authorities, bringing the illegalities to their notice. However, despite the said representations, the official respondents have failed to take any action. Hence, the petitioner filed the present writ petition.

On the other hand, the learned Standing Counsel appearing for the respondent Nos.2 to 4 would submit that the representations dated 29.12.2025 and 06.02.2026 will be considered, if not already considered, and appropriate action would be initiated, in accordance with law, and would submit to pass appropriate orders.

Heard the learned counsel for the petitioner, learned Assistant Government Pleader for Municipal Administration and Urban Development appearing for respondent No.1 and Sri K.Ravi Mahender, learned Standing Counsel appearing for the respondent Nos.2 to 4 and perused the material made available on the record.

The main grievance of the petitioner is that though they brought to the notice of the respondent Nos.2 to 4, by way of representations dated 29.12.2025 and 06.02.2026, about the illegal/unauthorised construction at Gokul Enclave Apartment, Jeedimetla, the respondents Nos.2 to 4 have failed to initiate any action against the illegal construction made by the respondents No.5.

Since this Court, time and again, directed the Municipal Authorities to initiate action against the illegal constructions by following due process of law, it is noticed that the authorities are failing to initiate action against the illegal constructions. However, in some of the cases, authorities are issuing statutory notices and thereafter not proceeding further to initiate further course of action unless writ petitions are filed for not considering complaints/

representations made to civic authorities.

It is not out of place to mention Section 7(6) of the Telangana State Building Permission Approval and Self Certification System (TS-BPASS) Act, 2020 (for short ‘the TS-BPASS Act’) which also encourages citizens to put on notice to the Civic Authorities regarding unauthorized constructions. Section 7(6) of the TS-BASS Act is extracted for reference.
