...Respondents

ORDER :

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

“….Issue a Writ, Order or Direction one more particularly in the nature of Writ of Mandamus a) Declaring the action of the Respondents in undertaking excavation works and disturbing the existing pipe line structure on the North West Canal at Channel No.11/11, situated at Ramanthapur Village, Gundlapally Mandal, Nalgonda District as arbitrary, illegal, unwarranted and violative of Article, 14 and 21 of the constitution of India. and b) Consequentially direct the Respondents herein to continue the supply of water which is the only source of water and irrigation to the Petitioners fields and other lands in the said area c) And pass.…”

2. Heard Mr. R.Anurag, learned counsel for the petitioner; Mr. Laxmalla Sandeep, learned Assistant Government Pleader for Irrigation appearing for respondent Nos.1 to 3;

and perused the record.

3. The petitioner, an agriculturist, claims to be the absolute owner and possessor of agricultural lands admeasuring Ac.9.26 guntas situated in Sy.Nos.414,415, 420 and 421 of Ramanthapur Village, Gundlapally Mandal, Nalgonda District, and has been cultivating the said lands for more than three decades.

It is the case of the petitioner that the subject lands, along with other adjoining lands, are being irrigated through a pipeline connected to the North West Canal of the Dindi Project, particularly through distribution channel No.11/11, which has been in existence since the year 1968. The said pipeline is stated to be the sole source of irrigation for the petitioner and several other farmers in the locality. The grievance of the petitioner is that respondent Nos.2 and 3, without any notice or justification, commenced excavation and construction works at the canal site during the peak agricultural season, thereby disturbing and dismantling the existing pipeline, resulting in obstruction to the flow of water to the petitioner’s lands. It is further averred that despite informing the authorities, no remedial action was taken, and the acts of the respondents are alleged to be arbitrary, illegal, and violative of Articles 14 and 21 of the Constitution of India. The petitioner asserts that such interference would cause irreparable loss to crops and livelihood, as the petitioner has no alternative source of irrigation. Hence, the present writ petition is filed seeking appropriate directions, including a writ of mandamus, to declare the action of the respondents as illegal and to direct the restoration and continuation of water supply through the existing pipeline.

4. When the matter is taken up for consideration, learned counsel for the petitioner fairly submits that in view of the interim order dated 25.07.2018 passed by this Court directing continuation of supply of water to the petitioner’s lands through the existing pipeline structure on the North West Canal at Channel No.11/11, situated at Ramanthapur Village, Gundlapally Mandal, Nalgonda District, the petitioner is continuing cultivation in the said lands without there being any interference from respondent No.3 and seeks a direction of this Court to pass orders in terms of the said interim order passed by this Court.

5. Learned Assistant Government Pleader for Irrigation, while considering the submissions of the learned counsel for the petitioner, seeks liberty to the official respondents to lay new pipelines without disturbing the existing pipeline structure as claimed by the petitioner herein, if necessary.

6. Having heard the submissions of the learned counsel for the petitioner and learned Ass
