ORDER:

Heard learned counsel for the petitioner and Sri G.Madhusudhan Reddy, learned Standing Counsel for GHMC appearing for respondent Nos.2 and 3. With the consent of both the parties, the writ petition is being taken up for disposal.

2. This writ petition has been filed seeking the following prayer:-

“to issue a Writ, Order or Direction, more so, a writ in the nature of mandamus, by declaring the inaction of the respondents, in not considering the complaint of the petitioner dated 14.10.2025, for taking action against illegal constructions being made on the Plot No.33, in Sy.No.197 belonging to the petitioner, as arbitrary, illegal, highhanded and violative of principles of natural justice and consequently, to direct the respondents to conduct enquiry and demolish and stop the illegal constructions being made by the 4th respondent, on the property of the petitioner, and may pass such other order or orders...”

Learned counsel for the petitioner submits that the petitioner claims to be the absolute owner and possessor of the property bearing Plot No.33, admeasuring Ac.80 Sq. yards, situated in Sy.No.197, at Jai Jawahar Nagar Colony, Yapral, Medchal Malkajgiri District, having purchased the same by virtue of a registered sale deed dated 27.09.2012. It is contended that respondent No.4, who claims to have property in Sy.Nos.184 and 195, is illegally encroaching upon the petitioner’s property in Sy.No.197 by wrongly projecting his property as Plot No.9-A and is undertaking illegal and unauthorized constructions without obtaining any permission or sanctioned plan from respondent Nos.2 and 3 and without having any manner of right, title or possession over the petitioner’s property. It is further submitted that earlier also similar illegal constructions were undertaken in the very same locality and upon intervention of the revenue authorities, it was found that the constructions were in Sy.No.197 and not in Sy.Nos.184 and 195 and accordingly, such illegal constructions were demolished. It is submitted that even in the present case, the respondent No.4, by creating and relying upon fabricated documents, is attempting to encroach upon the petitioner’s land and is continuing the illegal construction by using force and influence, despite having no valid permission.

It is further submitted that the petitioner had submitted a written complaint dated 14.10.2025 to respondent Nos.2 and 3 bringing to their notice the illegal and unauthorized construction being undertaken by respondent No.4 in the petitioner’s property. Despite receipt of the said complaint and subsequent personal visits, no action has been taken by the respodnent authorities for stopping the illegal construction. It is submitted that the inaction of respondent Nos.2 and 3 is arbitrary, illegal and contrary to law, thereby compelling the petitioner to approach this Hon’ble Court. It is further submitted that though several grounds are raised in the writ petition, learned counsel for the petitioner confines his submissions to the extent of seeking a direction to the respondent authorities to consider the complaint submitted by the petitioner dated 14.10.2025 and to take appropriate action in accordance with law against the illegal constructions being carried out by respondent No.4.

5. Learned standing counsel for GHMC submits that to the extent of the consideration of complaint of the petitioner, the respondent authorities would consider the same and pass appropriate orders in accordance with law.
