Heard Mr. Badra Nanavath, learned counsel for the petitioner, Mr. K. Goutham Kumar Reddy, learned Assistant Government Pleader for Mines and Geology, appearing for respondent Nos.1 and 3, learned Assistant Government Pleader for Revenue, appearing for respondent No.2, and learned Assistant Government Pleader for Home, appearing for respondent No.4.
2. Learned counsel for the petitioner submitted that in similar circumstances, this Court has disposed of W.P. No.690 of 2026 by the order dated 08.01.2026 and prayed to grant similar relief in favour of the petitioner herein. The same is not disputed by the learned Assistant Government Pleader for Mines and Geology, appearing for respondent Nos.1 and 3.
3. In view of the above, the writ petition is disposed of, granting liberty to the petitioner to submit representation to respondent No.4 along with all the original documents to prove his ownership over the subject vehicle and pay requisite penalty to respondent No.4 in terms of Rule 12 of the Telangana State Sand Mining Rules 2015 (amended under G.O. Ms.No.15 Industries and Commerce (Mines - I) Department dated 19.02.2015) (for short ‘Rules 2015’). On receipt of the requisite penalty, respondent No.4 shall consider the representation of the petitioner, and pass orders, by affording opportunity of hearing to him, in accordance with the Rules 2015, within a period of two (2) weeks thereof. There shall be no order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
