ORDER:

This writ petition is filed seeking the following relief/s :

“…to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the acts of the respondent No.3 in not considering the representation submitted by petitioners and not providing the Rehabilitation and Resettlement benefits, by consistently decreasing the amount to be paid out for the said benefits from Rs.11,64,000/- to Rs.7,61,000/- under one pretext or the other unreasonably to the detriment of the petitioners despite acquisition of Agricultural Lands and Residential houses and Lands for Kistaram OCP, in Jagannathapuram Village, Cherukupally Grampanchayat, Sathupalli mandal, as illegal, arbitrary, in violation of Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013, RFCTLARR Act 2013, Articles 14, 21 of Constitution of India and in violation of principles of natural justice and consequently to direct the respondent authorities to provide rehabilitation package as firstly decided for Rs.11,64,000/- or in accordance with rehabilitation benefits granted in other projects in Telangana and resettlement benefits as mandated and in accordance with the provisions of Right to Fair Compensation, Transparency in Land Acquisition Rehabilitation and. Resettlement Act, 2013, before displacing the Petitioners for Kistaram OCP and pass such other order or orders as this

Honourable Court deems fit and necessary in the interest of justice, and pass…”.

It is not in dispute that the Government had issued a preliminary notification dated 29.01.2019, which was published on 07.02.2019, for the purpose of Construction of Kistaram O.C.P Project in Jagannathapuram Village, Cherukupally Grampanchayat, Sathupally Mandal, Khammam District. Pursuant thereto, respondent No.5 had passed an award in R.C.No.C/11/2018, dated 09.07.2019, whereby the compensation was awarded in favour of the petitioners in respect of their respective lands in lieu of acquisition of the said lands among

other.

The present writ petition is concerning the R&R benefits, which the respondents proposed to consider upon conducting social economic survey in terms of Section 16(1) of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (RFCTLARR Act), proposing to grant benefits which are quoted in Paragraph No.11 in Page No.10 of the counter affidavit filed by respondent No.5. The said proposal was made in terms of the schedule

annexed to the G.O.Ms.No.92, Revenue (JA&LA) Department, dated 31.05.2017. However, subsequently, the said proposal was revised by reducing the said benefits drastically, including reduction of housing assistance from Rs.5,04,000/- to Rs.1,25,000/-. Similarly, even in respect of other heads also amounts were substantially decreased. Challenging the said action of the respondents, the petitioners have invoked the jurisdiction of this Court under Article 226 of Constitution of India. Such reduction according to the petitioners is arbitrary and unjustified contrary to statutory mandate and discriminatory and therefore sought a direction to the concerned respondents to provide R&R package, as proposed initially and in accordance with the
