This writ petition is filed seeking the following prayer:

“…to issue a Writ Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents, especially the 3rd Respondent, in not acting upon the representation of the petitioner dated 07.02.2026 and proceeding to pass consent award and disburse the compensation amount in the name of 5th to 9th respondents, in violation of provisions of Act 30 of 2013 as amended by Act 21 of 2017 read with Rules notified vide G.O. Ms.No.120 dt 30.06.2017 and without referring the dispute, relating to the person entitled to receive compensation to the competent authority as illegal, arbitrary, unconstitutional, against the principles of natural justice and consequently direct the 2nd and 3rd respondents to act upon the representations of the petitioner dt 07 02 2026 in accordance with law before passing of compensation award for the land admeasuring Ac.6.30 Gts in Survey No 332/E/1/1/1, 332/AA/3, 332/A/EE/1/1/2, 332/A/EE/1/2, 332/AA/1, 332/A/EE1/1/1/1, 332/E/1/1/1, 332/ A/2/2, 332/A/2/1, 332/A/ AA, situated at Kodangal Kanukarthi Shivar Narayanapet District and pass…”

2. Heard Sri C.Prabhakar, learned counsel for the petitioners and learned Assistant Government Pleader for Revenue (Land Acquisition) for respondent Nos.1 to 4.

3. Brief facts of the case as stated are that petitioner No.1 is the mother and legally wedded first wife of respondent No.5, who is the father of petitioner Nos.2 and 3. Respondent No.6 is the second wife of respondent No.5 and respondent Nos.7 to 9 are also the children born to them. It is submitted that respondent No.5 inherited a property admeasuring Ac.9.30 guntas in Survey No.332 from his grandfather and the petitioners are in possession of the said property. Respondent No.3 issued a land acquisition Notification bearing No.F/7326/2025 dated 25.08.2025 for an extent of 395.01 Acres for the purpose of Kodangal Lift Irrigation Dam and the petitioners’ land was included in the said notification. According to the petitioners, an extent of Ac.6.30 guntas was recorded in the names of respondent Nos.5 to 9, while an extent of Ac.3.00 guntas was recorded in the name of the petitioners. Subsequently, the petitioners submitted a representation dated 07.02.2026 to the concerned Authorities stating that they are in Khastu and requested to stop issuing cheque. However, the Authorities failed to act upon the said representation and are trying to disburse the compensation amount to the respondents and that there is a threat of dispossession to the petitioners from the said land. Aggrieved thereby, the present Writ Petition is filed.

Learned Assistant Government Pleader for Revenue, on instructions from respondent No.3 - Land Acquisition Officer, RDO, Narayanpet, submitted that a preliminary notification was issued on 23.10.2025. Further, in response to the said notification, nine objections were received within the stipulated period, from the date of issuance of the notification and the same were considered and disposed of under Section 15(3) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act 30 of 2013). Thereafter, the Land Acquisition Officer and the Revenue Divisional Officer submitted declaration proposals to the District Collector, Narayanpet, for approval. The District Collector, in turn, approved the Declaration in Form-VII vide Progs.No.G/1151/2026 dated 26.02.2025 and issued Gazette No.71 of 2026.
