ORDER

The present Writ Petition is filed seeking the following relief:

“...to issue a writ, order or direction, more in the nature of Writ of Mandamus declaring the inaction on the part of the Respondents herein in not preventing encroachment on the footpath in front of the property of the Petitioner bearing No.1-8-30/5/X, situated at Ministers Road, Bholakpur, Secunderabad blocking his ingress and egress by unauthorized persons and making constructions on the footpath as illegal, arbitrary and consequently direct the Respondents to remove the same and keep it open and peaceful and to pass...”

2. Heard Sri.V.Hariharan, learned senior counsel appearing on behalf of the petitioners as well as Sri G. Madhusudhan Reddy, learned Standing Counsel for the Greater Hyderabad Municipal Corporation. Perused the record.

3. When the matter was taken up for hearing, the learned Standing Counsel for respondent Nos. 2 and 3 submitted that action had already been initiated to remove encroachments and that continuous efforts were being made to prevent encroachment on footpaths by street hawkers.

4. In view of the said submission, this Court deemed it appropriate to close the Writ Petition. However, this Court clarified that if any street hawkers or vendors obstruct the road or footpaths in the future, the concerned authorities are obligated to take appropriate action, strictly in accordance with the due process of law. Accordingly, the Writ Petition is closed. There shall be no order as to costs.

Miscellaneous petitions, pending if any, shall stand closed.
