ORDER:

This Criminal Petition is filed by the petitioners-accused Nos.1 and 2 seeking to quash the proceedings against them in Crime No.558 of 2021 of Ramachandrapuram Police Station, Cyberabad, registered for the offences under Sections 420 and 406 I.P.C.

2. Heard Sri P. Nagendra Reddy, learned counsel for the petitioners, Sri Jithender Rao Veeramalla, learned Additional Public Prosecutor for respondent No.1-State and Sri K.M. Mahender Reddy, learned counsel for respondent No.2.

Learned counsel for the petitioners submitted that two F.I.Rs. are registered based on the same cause of action arising out of the same incident and that in the first F.I.R., charge sheet is already filed. He further submitted that respondent No.2-de facto complainant has resorted to file second complaint, which is bad in the eye of law and that the second F.I.R. needs to be quashed as per the principle laid down by the Honourable Apex Court in T.T. Antony v. State of Kerala and others, 1(2001) 6 SCC 181 and Babu Bhai v. State of Gujarat, (2010) 12 SCC 254. He, therefore, prayed to quash the proceedings against the petitioners in the present crime.

Learned counsel for respondent No.2 has submitted that both the F.I.Rs. arose out of different causes of action; that earlier the petitioners have filed Crl.P.No.5135 of 2021 seeking to quash the proceedings in the earlier Crime No.475 of 2021 of Madhapur (Guttala) Police Station, Cyberabad, and the same was withdrawn as charge sheet was filed; and that in the earlier complaint, only cheating was alleged, but in the present complaint, it is further alleged that the petitioners have stolen the machinery belonging to the de facto complainant. He, therefore, prayed to dismiss the Criminal Petition.

6. The first F.I.R. i.e., F.I.R.No.475 of 2021 is dated 22.04.2021. It is registered based on the complaint given by the de facto complainant stating that the petitioners have cheated him by promising him with huge returns on his investment. It is the case of the de facto complainant that his Company is into promoting green technologies and products, mainly into reducing the consumption of diesel and fuel related products in industrial applications. Petitioner No.1-accused No.1 through his videos came into contact with him and has induced him stating that he has developed a new system in the said field, achieved maximum results and can help his Company in improving its business to maximum and that he had a Company by name M/s. Hydro Systems Private Limited, being run by him and his wife (accused No.2) since 2013. He introduced himself as a Managing Director of the said Company. Getting influenced by his version, the de facto complainant has invested around Rs.60 lakhs for supply of necessary machinery, data, knowledge and for developing his Company. It is alleged that after receiving the said amount, petitioner No.1-accused No.1 has not shared anything and has not aided in any way to his Company and that in lieu of the amount taken, he has kept some documents as security with him and on enquiry, he learnt that the said documents are found to be fake. Thus, the petitioners have deliberately cheated him. It is also mentioned that the petitioners have not handed over the machinery belonging to him, which are kept in the premises of the petitioners. With the said set of allegations, the first complaint was lodged and F.I.R.No.475 of 2021 was registered for the offences under Sections

406 and 420 read with 34 I.P.C.
