ORDER:

This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief:-

“…to issue Writ, order or direction specially in the nature of Writ of Mandamus declaring the action of the respondents 1 to 4 in not taking action to demolish the unauthorized construction made by the 5^th respondent in premises bearing No.14-4-89, Multanipura, Begum Bazar, Hyderabad as illegal, arbitrary and unconstitutional and consequently direct the respondents 1 to 4 to demolish the illegal construction made by the 5^th respondent in premises bearing No.14-4-89, Multanipura, Begum Bazar, Hyderabad and pass such other order as this Hon’ble Court may deem fit and proper in the circumstances of the case...”

2. Heard Sri A.Mahadev, learned counsel for the petitioner, Sri Midde Arun Kumar, learned Standing Counsel for GHMC, appearing for respondent Nos.2 to 4 and Sri Mekala Santosh Kumar, learned counsel for respondent No.5. Perused the record.

When the matter is taken up for hearing, learned counsel for the petitioner would contend that the petitioner has filed an application seeking regularization of the illegal constructions/ deviations under due acknowledgment of payment, dated 24.12.2015 of Rs.10,000/-, and the same is pending consideration.

4. Per contra, learned Standing Counsel for respondents does not controvert the submissions made by learned counsel for the petitioner.

5. A perusal of the said receipt, apparently indicates that an application was filed for regularization of unauthorized constructions/deviations under the regulation scheme.

This Court, in a series of writ petitions, held that once an application is filed for regularization of the proceedings under the scheme quoted by respondent Nos.2 to 4 and under G.O.Ms.No.152, dated 02.11.2015, the authorities are duty bound to consider the said application and pass appropriate orders. However, pursuant to the orders passed by the Hon’ble Division Bench of this Court in public interest litigation, the matter is carried up to the Hon’ble Supreme Court of India where the matter is Sub-judice.

In view of the above, respondent Nos.2 to 4 are directed to scrutinize the application filed by the petitioner, within a period of eight (8) weeks, from the date of receipt of a copy of this order and if any deviations are found to be eligible to be regularized under the LRS Scheme, orders shall be kept in abeyance, till the disposal of the proceedings, before the Hon’ble Supreme Court of India. It is made clear that pending consideration of application submitted by the petitioner and during the pendency of the proceedings before the Hon’ble Supreme Court of India, no coercive steps shall be taken against the petitioner in respect of the unauthorized constructions/deviations.

8. With the above directions, the Writ Petition is disposed of.

No costs.

Miscellaneous petitions, if any are pending, shall stand closed.
