ORDER:

This writ petition is filed questioning the action of respondent

No.3 in marking on the houses/shops and trying to demolish the houses/shops of the petitioners herein for the purpose of road widening from NTR Marg Road to M.G.Road Railway Track end Road in Kagaznagar Town, Komarambheem Asifabad District (hereinafter referred as ‘subject road’) without issuing prior Notices, without following due process of law, without paying the compensation to the petitioners in respect of their Houses/Shops situated at M.G.Road Railway Track end Road in Kagaznagar Town, Komarambheem Asifabad District as being illegal, arbitrary and in violation of Principles of Natural Justice and in violation of Article 300-A of the Constitution of India. A consequential direction was sought to

respondent No.3 not to demolish the houses/shops of the petitioners situated at M.G.Road Railway Track end Road in Kagaznagar Town, Komarambheem Asifabad District without issuing prior notices,

without following due process of law.

Brief facts of the case as stated are that the petitioners claims to be the owners and possessor of their respective properties situated at M.G.Road, Kagaznagar Municipality jurisdiction of Komarambheem Asifabad District and some petitioners are using their properties for residential purpose and petty business purpose and the petitioners are paying property tax regularly to the respondent No.3 Municipality. It is further submitted that respondent No.3 is taking steps to widen the subject road for the purpose of urbanization and the present road therein is 20 feets and the respondent No.3 is widening the said road from 20 feets to 40 feets. It is further submitted that petitioners have approached respondent No.3 office requesting to not to demolish their properties though they have not opposed the road widening but there is no necessity in the M.G.Road area because it is a dead end to Railway Track but, the authorities expressed their view to widen the road on that they requested the authorities to follow due process of law after paying the compensation amount but, the respondent authorities are not considering to their request and marking their

properties. Aggrieved by the same, the present writ petition is filed.

3. On the other hand, Mr. Putta Krishna Reddy, learned Standing Counsel appearing for respondent No.3 would fairly submit that the

respondent authorities while widening the subject road would follow

due process of law and prayed to pass appropriate orders.

4. Heard learned counsel for the petitioner and learned Standing Counsel appearing for respondent No.3 and perused the material

made available on the record.

Having considered the above facts and circumstance, recording the submission made by the learned counsel appearing on either side, without expressing any opinion on the merits of the case, this Court deems it appropriate to dispose of the writ petition directing the respondent No.3 to follow due process of law while widening the

subject road.

6. With these observations, this writ petition is disposed of. There

shall be no order as to costs.

As a sequel thereto, miscellaneous applications if any pending

in this petition, shall stand closed.
