The court directed the respondent authority to receive and consider a representation for enhancement of compensation under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, after the initial submission was refused.

ORDER:

This Writ Petition is filed questioning the action of respondent No.3 in refusing to receive and consider the petitioner’s application/representation dated 13.12.2025 submitted under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act 30 of 2013), seeking enhancement of compensation on various grounds.

Heard Smt. G.Jhansi, learned counsel appearing on behalf of the petitioner, learned Government Pleader for Land Acquisition appearing on behalf of respondent Nos.1 to 3 and the learned Government Pleader for Irrigation & CAD Department appearing on behalf of respondent No.4. With their consent, this writ petition is taken up for disposal.

Learned counsel for the petitioner submits that the petitioner submitted a reference application dated 13.12.2025 to respondent No.3 seeking a reference to the Land Acquisition, Rehabilitation and Resettlement Authority (LARRA), Hyderabad, under Section 64 of Act 30 of 2013 for enhancement of compensation on various grounds. It is further submitted that the said representation was sent through Speed Post Acknowledgement Due (SPAD), but the same was returned with an endorsement “Refused” dated 16.12.2025, indicating that respondent No.3 refused to receive the same without assigning any valid reasons. Aggrieved thereby, the present Writ Petition is filed.

Learned Government Pleader for Land Acquisition appearing for respondent Nos.1 to 3 submits that the petitioner’s representation dated 13.12.2025, seeking enhancement of compensation under Section 64 of Act 30 of 2013, will be considered by the competent authority.

Without going into the merits of the case, and recording the submissions made by the learned Government Pleader, this Court deems it appropriate to dispose of the Writ Petition by directing the petitioner to submit a copy of representation dated 13.12.2025 before respondent No.3 by hand, within a period of one (01) week from the date of receipt of a copy of this order. Upon such submission, respondent No.3 shall consider the petitioner’s representation in accordance with law and shall make a reference to the competent authority under Section 64 of Act 30 of 2013 within a further period of three (03) weeks.

With the above directions, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any pending in this petition, shall stand closed.
