ORDER:

This writ petition is filed questioning the action of respondents in not considering the petitioner’s representations dated 13.11.2024 and on subsequent dates made by several residents of Irrikunta Tanda Gram Panchayat, Shankarpally Mandal, Rangareddy District requesting to relocate / remove the Kollur Compost Shed / Dump Yard from its current location as it is abutting to the petitioner’s property. A consequential prayer is sought to direct the respondents to consider the petitioner’s representation dated 13.11.2024 and other representations made by residents of Irrikunta Thanda to relocate /

remove the Kollur Compost Shed / Dump Yard from its current location.

2. The facts giving rise to filing of the present writ petition are as follows:

The petitioner submits that he is a permanent resident of Irrikunta Thanda, Shankarpally Mandal of Rangareddy District. The petitioner is in possession of land admeasuring Ac.2-00 guntas situated in Survey Nos.33 and 34 in Maharajpet, Shankarpally Mandal, Rangareddy District. It is submitted that the petitioner’s property is situated in close proximity to the Kollur Compost Yard (hereinafter referred as “subject site”) and near the village boundaries of both villages. It is submitted that the compost shed / dump yard existing on the periphery of Kollur Village and near the Irrikunta Gram Panchayat is under the management of Tellapur Municipality. The compost shed / dump yard is in a vacant land and is used for dumping and disposing all kinds of solid waste and garbage generated from households and commercial establishments in the said municipality.

The grievance of the petitioner is that the waste dumped in the open land of the dump yard is not being treated or managed by the respondent authorities as per the standards of Pollution Control Board and most of it is left to the open air, which results in releasing of foul smell. The said effect made the lives of villagers of Irrikunta Gram Panchayat miserable, as they live nearby. Besides that, the unhygienic disposal of waste in the dump yard has put the health of school going children and old aged people at risk. It is further submitted that as per Section 127(1) of the Telangana Municipalities Act (for short “the Act”), 2019, it is the responsibility of the Municipality to process the entire municipal solid waste by applying technologies, as prescribed by the Government or any of its agency. Further, as per Section 127(3) of the Act, the Municipality may identify the lands, which are at a reasonable distance from densely populated areas for the purpose of setting up of the future dump sites. It is further submitted that in compliance to the said provision, the said Kollur dump yard should have been located at a place far from habitation. However, it is located in proximity to the Irrikunta Gram Panchayat and is affecting the lives of more than 300 people.

The main grievance of the petitioner is that the said dump yard is abutting to the petitioner’s aforesaid land and accordingly made a representation was made to respondent Nos.2 to 4 on 13.11.2024 to relocate / remove the said dump yard from its current location and several other representations were also made by residents of Irrikunta Thanda with respect to dump yard / subject site to that effect. But, no action has been initiated by the respondent authorities upon their representations. Aggrieved by the inaction of respondent authorities, the present writ petition is filed.
