2. This writ petition is filed with the following prayer:

“to issue writ, order or direction, more particularly one in the nature of Writ of Mandamus, declaring in the action of the respondents No 4 to 12 in harassing the petitioner herein as illegal arbitrary and unjust contrary to norm of RBI Circular RBI/2019-20/186/ DOR NO. BP.BC.4721.04.048/2019-20, dated 27-03-2020, Guidelines of RBI Rules, dt.01.07.2015 and Resolution

dt.07.06.2019 in the interest of justice.”

3. The learned counsel for the petitioner submits that the respondent Nos.4 to 13 in violation of the R.B.I. guidelines dated 27.03.2020 are harassing the parents of the petitioner employing abusive language for recovery of loan amount. The petitioner seeks a direction to respondent Nos.4 to 13 to follow R.B.I. guidelines while

undertaking their activities for recovery of loan amount.

4. The learned counsel for respondent No.9 has given an undertaking that no measures beyond the R.B.I. guidelines would be employed while recovering the loan amount. Further, it is submitted that the guidelines relied upon by the petitioner are applicable to the Covid-19 Pandemic period, but not the present times. However, he has given an undertaking to follow R.B.I. guidelines and so also, the

learned counsel for respondent Nos.6, 7, 9 and 10 have

also given undertakings for following the R.B.I. guidelines.

5. Recording the said undertakings given by the learned counsel for respondent Nos.6, 7, 9, and 10, the writ petition is disposed of. However, there shall be no order as

to costs.

Miscellaneous petitions, if any pending in this writ

petition, shall stand closed.
