The court granted a stay on the operation of an ejectment order pending the disposal of a revision petition to prevent the petitioner's eviction while the legal challenge is being considered.

ORDER:

This Writ Petition is filed with the following prayer:

“… to issue a writ, order, or direction more particularly one in the nature of writ of Mandamus declaring the action of Respondent No.1 in not disposing off the Stay Application filed along with the Revision Case bearing No.1798 of 2025, dated 23.12.2025 before Respondent No.1 authority filed by petitioners herein as illegal, arbitrary, violation of articles 14, 16 and 21 of the constitution of India besides being contrary to the rules, regulations and the prescribed procedure and consequentially Stay the operation of Order Passed by Respondent No.2 in LTR Appeal No.A4/LTR/04/ 2024, dated 04.09.2025 confirming the ejectment order passed by Respondent No.3 in TWA1 /09/ 2024, dated 30/09/2024 until the disposal of the Revision Case bearing No.1798 of 2025 before Respondent No.1 authority in the interest of justice….”

2. Heard Mr. T. Srujan Kumar Reddy, learned counsel for the petitioners and Mr. S. Yogesh, Assistant Government Pleader for Social Welfare appearing for respondent Nos.1 to 3. Perused the entire record.

The learned counsel for the petitioners submits that the petitioners have preferred a revision before the respondent No.1 challenging the order dated 04.09.2025 passed by the respondent No.2 in LTR Appeal No.A4/LTR/04/2024 and the same is registered and numbered, but the stay application is not taken up for consideration till date. Since there is no stay order in the revision, the petitioners are facing threat of ejectment by the respondent No.3, therefore, he seeks stay of operation of the impugned order dated 04.09.2025 passed by the respondent No.2.

The learned Assistant Government Pleader for Social Welfare produced written instructions stating that the revision in R.P.No.1798/TW.LTR/2025 is pending consideration before the respondent No.1 and submits that the main writ petition may be disposed of by staying the impugned order dated 04.09.2025 till disposal of the revision pending before the respondent No.1.

Having regard to the submissions made by both the counsel, the Writ Petition is disposed of by staying the operation of the impugned order passed by respondent No.2 in LTR Appeal No.A4/LTR/04/2024, dated 04.09.2025, till disposal of the revision in R.P.No.1798/TW.LTR/2025 pending before the respondent No.1. However, there shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this writ petition, shall stand closed.
