ORDER:
Heard learned counsel for the petitioner, learned Government Pleader for MA&UD appearing for respondent No.1 and Sri.G.Madhusudhan Reddy, learned standing counsel for GHMC appearing for respondent Nos.2 to 4. With their consent, the writ petition is being taken up for disposal at the admission stage itself.
2. This writ petition has being filed seeking the following prayer:-
“to declare in action of the respondent No.2 not taking any action on the representation dt 30.03.2026 made by the petitioner to take action on illegal construction of Residential building constructing by the 5th respondent at Sy No.11/23, 11/25 and 11/27, situated at Chandanayak Nagar Thanda, Kanemet, Near YSR Statue 100 feet Road, Madapur, Hyderabad, constructing G + 8 upper Floors without obtaining building permission from the Municipal authorities is illegal, arbitrary and violation of provisions of the GHMC Act and consequently directs the respondent No.2 to 4 stop the illegal construction of the 5th respondent.”

Brief facts as stated in this writ petition are that the petitioner’s neighbor i.e., respondent No.5 without obtaining building permission is unauthorizedly constructing ground + eight upper floors at Sy No.11/23, 11/25 and 11/27, situated at Chandanayak Nagar Thanda, Kanemet, Near YSR Statue 100 feet Road, Madapur, Hyderabad. The petitioner on 30.03.2026 made a representation and requested the respondent authorities to take action against the illegal construction, however, the same is still pending for consideration. Aggrieved by the pending consideration, the present writ petition is filed.

The learned standing counsel for GHMC appearing for respondent Nos.2 to 4 submits that the respondent No.3 had issued show cause notice bearing No.083/UC1/TPS/C50/KPZ/CMC/2026, dated 26.03.2026, directing the respondent No.5 to stop the work forthwith and show sufficient cause by a statement in writing within (15) days from the receipt of this notice, enclosing supporting documents. The respondent No.5 was further directed to appear in person on 04.04.2026 at 12:30 pm in the chambers of Deputy Commissioner, Circle No.50, for personal hearing. Learned standing counsel would further submit that the respondent No.5 neither attended personal hearing nor submitted any explanation, hence, the respondent No.3 issued notice bearing No.083/UC2/TPS/C50/KPZ/CMC/2026, dated 08.04.2026 and directed the respondent No.5 to remove the unauthorized construction within (15) fifteen days. It is submitted that earlier the subject property was seized on 01.04.2026, however, when the same was reopened, the respondent authorities again reseized the subject property on 18.04.2026 and banner to that effect was also stick on the subject building. To support his contentions, learned standing counsel has placed on record a copy of photograph of the subject property.
5. The learned standing counsel for GHMC further submits that the respondent authorities would take further action in accordance with law.
6. In the case on hand, it is pertinent to refer to Section 7(6) of the Telangana State Building Permission Approval and Self Certification System (TS-BPASS) Act, 2020 (for short ‘the TS-BPASS Act’), the same are extracted hereunder:-
“7. Approval of Building Permissions-
(6) Citizens shall be encouraged to bring to the notice of Municipality and District Collector cases where unauthorized construction or construction in violation of or in excess of permissions, in the manner prescribed.
