ORDER:

Heard learned counsel for the petitioners and Sri Krishna Reddy Putta, learned standing counsel for Municipal Administration and Urban Development appearing for respondent Nos.1 & 2. With the consent of both the parties, the writ petition is being taken up for disposal.

2. This writ petition has been filed seeking the following prayer:-

“to issue a Writ of Mandamus declaring the action of the Respondent No.2 in passing the speaking order dated 20.01.2026 vide letter No.File.No.G1/OW/600/2025, revoking the validly granted building permission vide No.4397929/SIDD/1421/2024, dated 25.10.2024 granted in favour of the petitioner, solely on the ground of pendency of civil disputes is illegal, arbitrary and in violation of Articles 14, 21 and 300-A of the Constitution of India apart from being in violation of Telangana Municipalities Act, 2019 and consequently set-aside the said Speaking Order and may be pleased to pass such other order or orders as this Hon’ble Court may deem fit and proper in the interest of justice.”

Learned counsel for the petitioners submits that the petitioners claim to be owner and possessor of the premises bearing No.10-89/2, admeasuring 209.34 Sq.Yards in Sy.No.395 of Ensanpally Village, Siddipet Urban, Siddipet District and submits that the petitioner purchased the said property by way of a registered sale deed Doc.No.9785/2019, dated 28.06.2019 from the original owner.

It is further submitted that, the respondent No.2 has granted permission to construct a residential building through TG-bPASS U/Sec.174(2) of Telangana Municipalities Act, 2019 granting permission to construct Ground + 2 Upper Floors over the subject property and thereafter issued approval for commencement of work vide permit No.4397929/SIDD/1421/2024, dated 25.10.2024. Thereafter, the petitioner had completed the construction.

It is further submitted that the respondent No.2 has issued a notice on 29.09.2025 directing the petitioner to submit certain documents and also directed to stop construction work stating that the office of the respondent No.2 has received a complaint on 23.09.2025 from respondent Nos.3 and 4 alleging unauthorized construction. The petitioner thereafter submitted an explanation to the show cause notice dated 29.09.2025 along with all the relevant documents on 04.10.2025. However, the respondent No.2 issued a speaking order dated 20.01.2026, revoking the sanctioned building permission dated 25.10.2024 solely on the ground of pendency of civil disputes between the petitioner and unofficial respondents. Questioning the same, the said writ petition is filed.

6. It is submitted that the respondent No.3 has filed a suit by way of O.S.No.390 of 2025 for mandatory Injunction and recovery of possession which is pending before the Principal Junior Civil Judge, Siddipet.

7. It appears from the record that the disputes are pending on the subject land between the petitioner and the respondent Nos.3 and 4 and Criminal Complaint has been filed both by the petitioner and respondent Nos.3 and 4, which is also pending for investigation.

Learned counsel for the petitioner has drawn attention of this Court to the sale deed document executed in favour of the petitioner Sri Madani Ashok and also permission dated 25.10.2024 which was issued under TG-bPASS Act for construction of Ground+2 Upper Floors. Learned counsel also placed copies of the stages of construction and would submit that final construction is over and some internal works are pending and at this point of time, and issuance of the speaking order would affect the rights of the petitioner.
