: O R D E R :

This Writ Petition is filed seeking the following relief:

“…pleased to issue any appropriate writ, order or direction, more particularly one in the nature of Writ of Mandamus, (a) Declaring the action of Respondent No.2 in issuing the recommendations dated 29.10.2025 and 31.10.2025, whereby the fee for the 3-year and 5-year LLB courses offered by the Petitioner Institution for the block period A.Y. 2025-26 to A.Y. 2027-28 has been recommended at Rs.22,400/- per annum, despite the Petitioner Institution having proposed a fee of Rs.60,000/- per annum and Respondent No.2, after due consideration of the said proposal and upon personal hearing, having determined and approved a fee of Rs.55,000/- per annum for the 3-year LLB course and Rs.60,000/- per annum for the 5-year LLB course and the consequential action of Respondent No.1 in issuing G.O.Ms.No.11, dated 04.03.2026 notifying the said fee of Rs.22,400/- for both the 3-year and 5-year LLB courses offered by the Petitioner Institution for the block period A.Y. 2025-26 to A.Y. 2027-28 based on the recommendations of Respondent No.2 dated 29.10.2025 and 31.10.2025, as being wholly arbitrary, illegal, unconstitutional and without jurisdiction and in violation of the provisions of the Telangana Educational Institutions (Regulation of Admission and Prohibition of Capitation Fee) Act, 1983, the Telangana Admission and Fee Regulatory Committee Rules, 2006 and the law laid down by this Hon’ble Court and the Hon’ble Supreme Court of India and set aside the same, (b) Consequently direct the Respondents to notify the fee of Rs.55,000/- per annum for the 3-year LLB course and Rs.60,000/- per annum for the 5-year LLB course offered by the Petitioner Institution for the block period A.Y. 2025-26 to A.Y. 2027-28, as determined and approved by Respondent No.2 during the personal hearing and pass…”

Heard Mr. Tarun G.Reddy, learned counsel for the petitioners, Mr. K.Sharath, learned Assistant Government Pleader for Higher Education appearing for respondent No.1, Mr. G.Chandra Sekhar, learned Standing Counsel for Telangana Admission and Fee Regulatory Committee (TAFRC), appearing for respondent No.2 and Mr. Malipeddi Srinivas Reddy, learned Standing Counsel for Osmania University, appearing for respondent No.4. Perused the record.

3. Brief facts of the case:

3.1. Petitioner No.1 is a registered society established with the primary objective of providing educational facilities in the State of Telangana. In furtherance of its objects, petitioner No.1 promoted petitioner No.2-institution to offer 3-year and 5-year LL.B. courses. Petitioner No.2 has consistently received annual approvals from the Bar Council of India and requisite affiliation from the respondent university.

3.2. After the bifurcation of the State of Andhra Pradesh, the State of Telangana adopted the regulatory framework under G.O.Ms.No.6 through G.O.Ms.No.26, dated 22.07.2015. On the same day, TAFRC was constituted vide G.O.Rt.No.160, dated 22.07.2015.

3.3. Following the establishment of petitioner No.2 in the year 2023, respondent No.2, by proceedings, dated 10.07.2023, fixed the fee for the courses offered by petitioner No.2 at Rs.20,000/- in accordance with the prevailing regulatory framework.

3.4. For the block period of A.Y. 2025-26 to A.Y. 2027-28, respondent No.2 issued a notification, dated 15.07.2024 inviting proposals for fee fixation. The petitioners submitted their proposal seeking a fee of Rs.60,000/- for both 3-year and 5-year LL.B. courses along with requisite documents. A personal hearing was conducted and upon consideration of the material, respondent No.2 determined the fee at Rs.55,000/- for the 3-year LL.B. course and Rs.60,000/- for the 5-year LL.B. course. The petitioners acknowledged the same and the said determination was confirmed by letter, dated 08.07.2025.
