This Writ Petition is filed seeking the following relief:-
“…to issue a writ, order or direction more particularly one in the nature of writ Mandamus declaring the action of the 3rd respondent in passing the impugned order in Cr.No.C7/11/2026, dated 22.01.2026, rejecting the case of the petitioner for interim release of the petitioner’s Vehicle MARUTI DZIRE VXI bearing Registration NoTS05UF6607 as highly illegal, arbitrary and in violation of principles of natural justice, consequently direct the respondents to forthwith release the seized vehicle of the petitioner MARUTI DZIRE VXI bearing Registration No.TS05UF6607 and pass…”

Heard Sri Muthyala Muralidhar, learned counsel representing Sri Rathan Singh, learned counsel for the petitioner and Ms.Shilpa, learned Assistant Government Pleader for Excise appearing for the respondents and with their consent, this writ petition is being taken up for disposal at the admission stage.

Learned counsel for the petitioner would submit that the petitioner is the owner of the vehicle i.e., Maruti Dzire VXI bearing Registration No.TS 05 UF 6607, which was allegedly seized on 27.12.2025 at 07.00 A.M., at Hajipur Village road leads from Dindi, while it was transporting (5) litres of ID liquor and 600 Kgs. of Black Jaggery and 100 Kgs. of alum and basing on the confession- cum-seizure report, a case in C.O.R.No.174 of 2025 was registered against the accused for the offences punishable under Section 7 (A) read with Section 8 (c) of the Telangana Prohibition Act, 1995 and 34 (e) of the Telangana State Excise Act, 1968 (for short “the Act”). Learned counsel for the petitioner submits that the respondent authorities issued a show-cause notice, dated 08.01.2026 vide Cr.No.C7/11/2026 directing the petitioner to show cause as to why the subject vehicle should not be confiscated and challenging the said show-cause notice, the petitioner filed W.P.No.917 of 2026 before this Court to direct the respondents to release the subject vehicle. By an order, dated 09.01.2026 a Coordinate Bench of this Court disposed of the said writ petition granting liberty to the petitioner to submit reply to the show-cause notice, dated 08.01.2026 and thereafter, respondent authorities are directed to consider the same and pass orders strictly in accordance with law, as expeditiously as possible. Thereafter, the petitioner filed a petition, dated 21.01.2026 seeking to release of the subject vehicle. Learned counsel for the petitioner would further submit that, respondent No.3, without considering the fact that the petitioner has hired the subject vehicle to accused No.1 and she is no way connected with the said illegal transportation and if the said vehicle is exposed to sun, rain and dust, it would get spoiled, had erroneously rejected the request of the petitioner vide proceedings Cr.No.C7/11/2026, dated 22.01.2026. Learned counsel for the petitioner would further submit that the petitioner is ready and willing to execute bond or surety for release of the said vehicle. Stating so, learned counsel for the petitioner seeks for release of the subject vehicle by setting aside the impugned proceedings.

Learned counsel for the petitioner would further submit that, on the last occasion i.e., on 13.04.2026, it was erroneously submitted that the present Writ Petition is connected to W.P.No.32164 of 2024 and hence, directed to post this Writ Petition along with W.P.No.32164 of 2024. Today, he submits that, W.P.No.32164 of 2024 was already disposed of by a Division Bench of this Court and seeks to delete the said submission, which has been inadvertently made before this Court on 13.04.2026.
